Hi Guys

 

I use to run a pub (left over a year ago) under Ltd Company. I wrote to creditors and told them that I ceased trading and closed down at Companies house. There were no objections from any of the creditors.

 

I now have a letter addressed to my home saying they are going to send someone round and take legal action for the debt on the Ltd company.

 

The house is not in my name and I have no assets.

 

Any help would be appreciated.

Not a lot they can do

 

I think you mean a debt collector

Who are powerless

They can't send baillifs

Its not been to court

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If you didn't sign a personal guarantee and didn't trade insolvent, you can point out you have no personal liability.

 

Even if they can show personal liability by one of the routes above, then you can point out you have no recoverable assets.

Hi PG

 

Check on companies house your old reg number print out the status.

 

Dig out the old taw or lease in the company name.

 

Dig out the contract you signed with until company.

 

Brief letter.

 

I refer to your letter dated x, please take noted the attached.

 

I have no personal liability for any alleged debt due as trading was under xyx Ltd company which is now dissolved.

This sounds like the old way admiral and enterprise signed you up to opus on the day you took over the pub.

I had the opus rep rock up with the area manager on signing my old lease. He was none too impresses when told to get out of my pub. I had signed with another supplier by phone. No way I was lining the agm s pocket with a commission for paying for NRG at an inflated rate.
