If they havent replied to a CCA request

then they are non-compliant and so cannot enforce the debt

so stop paying it rather than thinking about reminding them they are in the wrong.

 

I beleive that all of the admin charges and interest is reclaimable but flag that up with other here for advice.

and again a CCA request reminder is in order. They seem to have ignored that bit.

 

I have reduced the standing order to only pay £1 till that document is produced

 

No need to remind them, Idem know the law and are hoping that you do not.

 

Cancel the Standing Order now & stop paying until a CCA shows up, if a CCA ever does surface remove all of the personal identifiers and attach to your post to check if it is compliant.

IDEM should be named and shamed in the press for their behaviour towards you - disgusting doesn't even begin to express the way I feel about them after reading your battle.

So a final update,

 

Following a rather blunt written discussion, in which I sent a copy to my local MP to raise in the commons,

 

IDEM agreed to write off the debt in full.

 

They also today delivered the full contents of the SAR.

 

I suppose they finally did the right thing even though stating in their complaints resolution letter that they had done everything above board.

 

Irrespective, the goal was achieved to give my other half peace of mind for whatever years she has left.

 

She is now debt free, and I would just like to than you all for your support and giving me the conviction to stick to my guns.

I really don't know what made them change heart, whether it was the copies sent to BBC Watchdog and MP or whether I just made it pretty clear that as I was now in charge of the financial decisions they could whistle, or what I really don't know.

 

 

if MP got involved I certainly don't know about it, but I'd like to hope that it's started something.
