      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh yes and did I mention how excited I get each day, going home from work, looking at the pile of post!! How sad am I!!!

I'm about the same stage as you all at the moment waiting for DG Solicitors to tell me just what their defence will be - the clock's ticking down to 28/11/06..... Hi all

 

Been reading loads of threads especially the step to step guide........if you send your claim via MCOL, do I need to send another copy of the charges to the bank? Or hang fire until they respond?

 

Thank you again......getting a little nervous!!

 

I'd read on one of the threads they needed 2 copies of the schedule of charges (1 for the court & 1 to go with the claim..?) anyway, after doing my MCOL I printed them off, included a covering letter with the case/claim number & other relevent details & just sent them all off to Northampton. I've still got the address if you need it.

 

Good Luck - don't be nervous - the is the good bit now!

That's the address I used to send my copies off, all I put in the covering letter was my name, name of defendent, claim number & date of issue.

 

Babs - I'm sure it won't be too late, HSBC haven't acknowledged yours yet have they? Even if they have don't worry - just get both copies off & I'm sure it'll be ok - least they've got the info then.

Sorry for not getting back to you Babs - had one hell of an irong pile! Glad you received help though & very thorough it was too.

 

Halifax acknowledged my claim on 16/11/09 & received the notice from court telling me they intend to defend in full & have until 12/12/06 (28 days from date of service.) Looks like they had a run on the post - wonder if any of us will receive offers from solicitors now or if they really will try to defend claims.

 

I wish I'd done this sooner - the banks are probably getting seriously hacked off with all of this - it'll only be a case of time before they probably do try to defend. I know it's not in their interest to do that, but, can't help feeling very small at the moment!

Hi All Again,

 

Just checking how you're all doing!

Still nothing from DG for me - grrr! Ho Hum! D&G only have 14 days to send the AQ & sort their defence out:D I'm still fairly disgusted how little attention HSBC pay us folks - we're taking them to court for goodness sake - they've made a mint out of us - you'd think it'd count for something!! They're off my Christmas Card list anyway!

Hiya Peeps!

 

DON'T wait to send charges breakdowns to DG - get them sent ASAP as it looks like it might just speed things up.

 

Look at this - Abba the horse was really organised & after DG had acknowledged his MCOL & said they intended to defend in full he sent his breakdown off really quick & with still 2 weeks before they had to file on the 28th day DG have offered him full & final settlement!:p

Don't be stalled by DG - send them off sooner rather than later!

 

With the messing around putting MONEY INTO YOUR BANKS it might just be in BY CHRISTMAS!

Hey Hey Guys!

 

Check out the post! DG replied immediately :o to me after I faxed, emailed & posted the schedule of charges to them - with a FULL OFFER!!!! :p Cool!

I returned immediately with the confidentiality clause deleted ( why do we have to do this bit?) and fingers crossed they said it'd be in 7 days afterwards!

 

I can pay my arrears & we'll have Christmas after all!!!

 

Watch that postie - he'll be there with yours soon as well!!

I am ready to file MCOL against HSBC. The only thing I am concerned about is do you have to physically appear in a court if the bank don't settle the claim, or is it all done on your behalf. This has probably been answered elsewhere but there is so much to read and time is running out for me, as some of the charges date back to January 2001.

 

I would think you'd actually have to appear in court - but I shouldn't worry overly about that as it's unlikely it'll get to that stage - I claimed back to Oct 2000 & didn't have to - they're settling in full.:D
