Mom parked the car here.

 

 

The black car and got a PCN.

 

 

Directly under a UKPS sign that says private and no parking.

 

 

Is there any point in appealing?

 

 

She wasn't thinking as it was packed with cars and

 

 

when she got back, everyone got a ticket. There was no markings on the road at all.

 

Also the grace perid of 14 days is tomorrow.

 

 

She just showed me the ticket and asked me to pay.. sigh

Hi and welcome to CAG

 

I would ignore this ticket then wait for the Notice to Keeper. This should arrive between 29 and 56 days after the incident.

 

As this is a private parking ticket, it has nothing to do with a council and as such UKPS would have to go to court to get any pennies from you.

 

The best way to deal with this is to appeal to UKPS once the NTK arrives. It is very likely they will reject you but then you get to take this further to POPLA. In any rejection letter from UKPS they should include the POPLA code. You can then appeal further where more help can be given as needed.

 

You will also notice that the PCN says PARKING charge notice whereas an official one will say PENALTY Charge notice.

 

Have a read around to see what other victims have done. You will soon get the idea of what they can actually do.

when you get the notice to keeper, if it is within the alowed time you appeal enclosing a copy of the phot you have and say that the appeal is on the basis of inadequate signage as proven by the lack of signs to pass when parked thus.

They may reject with some stupid excuse but they should give you a POPLA code if they do. You will defeat them at POPLA as it is clear there are no signs whatsoever so how are you supposed to consider their offer of a contract. UKPS are pretty dumb but this is below their usual rubbish standard.

But the problem is she parked directly under the sign..... The wall is covered with advertisement, so she didn't see the sign posted over the advert. We will wait it out and appeal then.

You have answered your own ' problem '....

 

 

You , or your Mum are the reg keeper I take it?

exactly, you have to be able to see the sign from the drivers seat and it has to be clear as to what is being offered so it will fail on both counts. They wont accept that in your first appeal but their opinion means very little. If they wanted to advertise that a contract was being odffered it should have been at the entrance, facing forward so visible on entering the site, not somewhere down the road and hidden on the wrong side of a wall.
