QUESTION !!

 

I have just read a thread by Bankfodder saying to be sure to use your local branch address if you are claiming in England ! ?

 

That if you use the Scottish address ,you run the risk of it being processed according to Scottish law which is completely different ?

 

I am in North Yorkshire and posted my S.A.R to Glasgow before knowing any of this.

Should i be concerned ?

 

Any advice ?:-)

You should send it to your local branch, not sure if you should carry on and send the rest to your local branch or if you should start again and send your SAR to your local branch..someone will be along soon and be able to say.....:)

 

Started 25th Sep 2006 - got cheque on 4th December 2006. Settled without interest but full amount plus court costs :)

No it wont matter at this stage.It is at the actual claim stage that it matters,ie you make the claim against an address in England.But send every thing else (prelim,lba etc) to your local branch

Hi all.I have heard nothing so far,not even a confirmation of my request.:(

 

Having posted originally to glasgow,could i now go into my local branch with a reminder letter or should i stay with glasgow till i receive my statements ?

 

It's a little confusing.

 

Do i phone glasgow and ask how it's progressing and remind them how long is left or write reminder letter or wait longer (day 21 of 40)

 

Lastly ,and thanks for being patient :smile: ,do the time scales we use (40 days,14 &7 days) include weekends or just working/banking days ?

Letter came today dated 07/11/06 from Clydesdale confirming receipt of S.A.R.Stating they will send statements from October 2000 under the right of access under the Data Protection Act as soon as possible .They are aware they have 40 days from the 18/10/06.

Hi all :)

Just checking which of these are claimable .Can't find reference to one or two of these on the threads;

One in particular is confusing,it just says "CHARGES" with no reference to what for ? whereas the others are named.Been a while since i closed my account and no sure what it is ?

I also had the word *Charges* ....I claimed for them :)

It was a monthly charge at the end of the month for being overdrawn the previous month

 

Started 25th Sep 2006 - got cheque on 4th December 2006. Settled without interest but full amount plus court costs :)

21/11/06...Hand delivered my prelim over the counter at my local branch and got a receipt.£3,643.00

 

The cashier took my letter through the back of the open plan office and pointed out the C.A.G request for payment sticker to the manager,pointed me out and had quick chat.I was given a hard stare by the manager,one of those "I got your number " looks :mad: which i countered with a beaming toothy "can i have some cash please " smile ! :D.

 

Nice to see the stickers having an effect before the mail is even read.It was worth the small fee of £3.50 for 20 for this one instance.Recommended.:)

 

I have not gone contractual on this claim after some consideration ,partly due to the size of the claim and the difficulties had by all with this particular bank.

Reply to my prelim was sent the same day i delivered it.I get the feeling that my branch have not received one of these requests yet.

 

The reply looks to have been a template reply my branch has been given from head office .It has been printed with the Clydesdale address with Glasgow telephone numbers and has been printed over my branch address which is clearly visible.

 

Would them using the Clydesdale address have any bearing on my claim with regards to it being Scottish or English law ?.Especially if they keep using that address for any other correspondence ?

 

The reply is a categorical no we are not prepared to refund your charges.

 

Am i therefore within my rights to proceed to the next step of a letter before action or should i allow the 14 days to pass ?

The fact that they then deal with their Scottish HO is not a cause for concern, as long as you stick to the branch until you get a response to your moneyclaim. Under Court Procedures Regulations 28 days is considered reasonable before resorting to court action, which is 14 days for the preliminary letter, and 14 for the LBA, although some people cut this short. Definitely allow 14 days for the LBA though.

I apologise for not keeping my thread up to date but i have been rather busy,anyway ,here goes....

 

I sent my letter before action on 11/12/06 to which i got no response.

 

I then went on to file a claim with the courts on 08/01/07,which i have now found out the Yorkshire intend to defend.

 

The following day (09/01/07 ) I received a letter from Yorkshire dated 08/01/07 telling me the banks position remains as outlined in their letter dated 21/11/06,however after looking through my statements,2000 -2005,they wish to resolve the matter without the disproportionate expense of a court action.

 

Therefore they have enclosed a cheque for £1,803.00 , (half of what i am due ) tendered without admission of liability and in full and final settlement of my claim.

 

My encashment of the cheque will be taken as my acceptance of this finallity.

 

This letter is , ofcourse , without prejudice.
