      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a debt which I have been paying to Regal Credit at £30 per month for the last couple of years.

 

Every year RC hassle me to be paying more, which as a pensioner it is not possible.

 

I have ignored their last letter and the twice daily calls both to my home phone and mobile.

 

Today I received a letter stating the £1000 plus total and stating that they are recommending court action to their client

and threatening high costs and bailiffs. I am terrified.

 

First of all my very sick husband knows nothing of this debt and

 

second I am just beginning to think there might be an end to this as it is a relatively small amount.

 

Will they follow through on this course of action and what should I do?

 

Please help I would be grateful for any advice.

 

Do you think they would accept an offer of £500 to clear the debt?

have you ever fronted them with a CCA request?

 

a DCA is NOT A BAILIFF

Bolly... If you have been paying them then if this did go to court, it would only be made to pay what you can afford. I would double check you're not being cashcowed...

Write to Ray Spiteri the managing director, complain about the constant harassment letters, and state that you are paying all that you can reasonably afford.

 

 

Who is their client?

If your receiving a state pension with pension credits, you have no other income i.e. private/works pension then drop the payment to £1 pcm.

 

Thank them for the letter, you have personally reviewed your personal financial circumstances & therefore you can only afford £1 pcm.

If it ever went to Court, a Judge will not make you pay more than you can afford.

 

Keep everything in writing, the so called "specialist telephone agents" as they call them on their website are just wasters on minimal wage with both collection commissions & bonus enhancements which is why they threaten, intimidate, lie & say anything to get more out of you.

 

As DX says, if this debt is for a loan, credit card, store card etc. then send Regal a CCA request.

The debt is from bmi card. I know I should have done something from the beginning but I had

Not found you guys then. I was afraid to stop paying as I thought they might take it to court, as by paying I had admitted the debt. No I haven't CCA'd them, should I?

ah if it was the good old bmibaby/citicard? agreements and t&cs leave plenty to be desired:-)

Never thought they'd say that.

 

 

Next problem how can I stop them taking money from my card? I don't think I can stop it

Course you can. get your bank to block the transaction. As has already been said, you have been cashcowed for years.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Inform your bank that no further payments are to be made they Must stop the payments, if possible take a written instruction into a branch ask/demand to see a manager or senior member of staff, some may claim it cannot be stopped but they are wrong.

You have a Continuous Payment Authority on your card with Regal.

 

 

To make the cancellation request with the bank more likely to stick,

 

 

I suggest you use a template letter modified to suit.

 

The National Debtline one is here:

Once that is done,

I would be making sure Regal haven't been adding interest or charges to your account.

 

 

And that there was no PPI or unfair charges when it was with BMI either.

Check your credit files see what Regal has put on there, then be cheeky and ask them to remove all the adverse data.

 

 

I guess you will get some toys thrown out the pram when stop payments, debt still exists, morally oblige to pay etc.

I would never have the guts to try this if it wasn't for you guys.

 

 

I will cancel the payments and await the next tirade from Regal.

 

They have made my life hell for the past few months ringing me twice a day.

 

 

I am scared to answer my own phone or worse still one of my family answer.
