Hi all. I

 

had trouble with 1st stop loan company and was taken to court.

 

I received papers and filled in everything I needed to.

 

I sent in copies of emails I had sent them which they said I didn't respond to but I proved I had.

 

I also sent to court my I&e from stepchange which I'm currently with.

 

I've had no trouble from any other debts apart from these.

 

I received judgement of order and have been made to pay the loan amount which is fair enough

but then the court costs and other costs.

 

Have to pay it by 12 August which is impossible!

 

I can't believe the court has seen all my I&e and other documents I sent

but sided with a payday loan company.

 

What can I do?

 

I cannot pay this at all in the short time expected

Hi frustrated

Did you go to court in person ...only reason I ask is if you had done you could have defended yourself more ...the payday company will have had the upper hand on this with the judge I think ...sure there is something you can do but I am not in the know ...truly hope you get it sorted

So they have a ccj against you

 

How much roughly is the debt?

The payment date is when they may take further action depending on how much is owed

 

The next stage may be county court bailiffs or HCEO

Neither of them would have right of entry or forced entry to a residential address

 

EDIT you could contact the issuing court and make arrangements to pay at a affordable rate

You don't attend a hearing if you admit the debt. It's a paper exercise.

If it's a CCA regulated loan (very likely) they cannot use HCEOs.

 

If an offer was made and not brought to the court's attention there could be scope for a mandatory set aside. In reality it's probably better to ask to the court to consider a variation application to seek instalments. If the court have decided upon a lump-sum to be paid - you could instead request a redetermination.

You may have grounds for a setaside as they may have breached FCA conc rules.

However you have provided so little detail that it is not possible to form a firm opinion.

Please will you present your story properly in a bullet pointed chronology so that we can see what has happened.

Still waiting for a more detailed account about this story. If you want a chance to defend yourself against it then you have to tell us the whole story.
