don't forget mind

the fact that no CCA exists wont effect the CCJ result.

 

that over -rides the need for an agreement.

 

its not a set a side reason

Yes I understand that . It's just that these have been sold on to a DCA and I have been paying them for 20 years now. The debt was only about 3k but there were hundreds of pounds in charges added and I'am curious to find out exactly what I'am paying for now

once a debt has a CCJ, NOTHING can be added

that is not specifically mentioned in the judgement box of the CCJ.

In 1993/4 had a current account and credit card with TSB,

I lost my job and was unable to work due to illness.

Informed bank of my situation and they agreed to accept a token payment of £1 pm

 

In1995 they began sending letters for full payment, then defaulted it,

I didn't know what to do so went to my local advice centre for help.

 

I think I owed about 9 hundred pound on this card would have to check,

 

As I was now on disability benefit my advisor was able to negotiate a payment plan with LTSB for £2 pm. which I paid every month into the bank.

 

Then a few years ago credit security contacted me and said that I now had to pay them direct,

so it's £2 postal order plus 50pence to purchase it and 50pence postage that's another £1 that could be going off my debt.

 

Have had all sorts of letters from them Increase payments.

Pay in full.

Breached agreement because payment although sent had not been credited to my account

by the specified date which they keep changing, and on and on it goes,

 

about 18months ago I done a CCA request but was informed that this was not allowed as there was a CCJ on it.

But I know nothing about this.

 

I have never had a statement for this account so I don't know what's going on with it

 

The current account is a bit more complicated I will have to dig out all the old papers to see what went on.

have you this in writing that there IS a CCJ

 

and what date

 

and who was the claimant?

 

if this was said on the phone

then i'd seriously suspect something is very wrong.

never ever discuss debts over the phone.

 

 

dca's ARE NOT BAILIFFS

 

and have

Paid LTSB into branch with payment book

 

Can't remember would have to go through my papers but it was quite a few years ago

 

Got piles and piles of papers going back to the 90's

Have you sent the SAR? Or just asked on the phone?

 

I just asked on the phone I was very naive and believed what people told me and didn't want any confrontation with them. HOW STUPID WAS I

Not stupid just conned. Intelligent pple get conned all the time.

 

Also look to see if you have any ppi on the card.

 

The days of you being conned are over. And actually as u will find. Knowledge is power and that stack of paperwork might contain the infomation you need to extract revenge :)

Yes they do I also still have the letters to and from the advice worker and LTSB that was helping me with this, she was trying to get them to stop charges and refund some of them. But this was unsuccessful ,until it finally got defaulted

Thank you SabreSheep So kind I'am only just beginning to understand what these low life's get up to. I don't think that I had PPI on this card but will check, 20years on won't it be a bit late to claim

OMG can't believe what I just read.

Personally, I'd stop paying them ask for a CCA. The rules changed in April 2007 that they need to provide one to make it enforceable. It doesn't wipe it out, but it'll give you a lot of breathing space.

It doesn't matter how much they jump up and down and threaten , they need to produce one!
