      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well, if you inform them of the death the interest accruing on any debt should be frozen (along with the rest of the account) and th executor of the estate (if there is a will, other than that the person sorting out the finances) should invite them to sendan account summary for payment to be made from the estate prior to redistribution.

 

Basically, if the deceased has any money, property, assests like shares, money in the bank, cars etc but NOT personal effects like furniture, items of jewellery or the like that are individual pieces then all of the identified debts should be paid out of that estate before the rest is divvied up according to the will or rules of intestacy. You dont need to send copies of the death cert to them, they have no right to demand it.

 

Now, if they were shopping at BH then I bet there are no Ferraris in the garage so you only have to worry about the cash. Once funeral costs are paid, will there be anything left? If so, pay off what is owed or what can be done for the council tax, then utilities and lastly anything else liek this. If there isnt enough money then just inform the creditors like BH that the person is deceased and left no estate.

 

No-one else as any liability for the deceased persons debts so dont let BT or BH tell you otherwise. You dont have to sell the furniture to pay off any debt as it is not part of the estate so again, if these people try and offer their "advice" , put the phone down on them as they tell lies in the hope that they get something. BT are the worst for this amongst utility companies but BG arent far behind by trying to assign accounts over to the person who contacts them etc.

I think CB is right.

 

As the goods are HP then they still belong to BH. They should take them back. They may ask for any arrears but that is all.

If you are asked to deal with any matter via private message, PLEASE report it.

Its my daughter-in-law that's passed away my son is only 35 and he hasn't got a clue how to deal with this he asked me to help him sort out her debts (most she had before she met him) that's why they are in her name only I think I should be able to deal with the rest of her creditors

 

 

she didn't hide the fact that she had debt and she spoke to me about it so I know she is with a debt management company (if that's the right word) step change I think but that's only been going about 6 months

 

 

and she has a debt with a company like provident

 

 

then there is brighthouse from memory I think she is still paying for a 3 piece suite I think she has had it about 18 months and a bed and bedroom furniture she has had that about a year

as I said that's from memory but I will get her paperwork

Have you contacted StepChange and advised them of your DiL's death ? If not, then they might be able to contact any creditors on your Son's behalf.

Have you contacted StepChange and advised them of your DiL's death ? If not, then they might be able to contact any creditors on your Son's behalf.

 

 

 

 

step change have been informed over the phone because we closed her bank account and her DD payment came from that account nothing been done in writing yet

are the creditors they were dealing with going to start sending letters these debts were mainly catalogues

BrightHouse will write off any active agreements and the full ownership will be passed over to the next of kin if they wish to keep them.

 

If they do not, they can either return them or dispose of them.

 

All the store require is a copy of the Death Certificate and the store will then be able to get this arranged as quickly as possible for your son.

Thank you very Much for your reply my son will be very relived to here this

 

 

my daughter-law and her Family all use Brighthouse and I believe they have done so for years the shop have not been informed but are aware of her passing the staff kindly sent her mother a card and flowers

 

 

Thanks again for your help

 

 

 

 

I will speak to her mum and ask her to take in a copy sometime next week
