      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes. They wont do anything for one case, but all complaints are collated, and the FCA is watching wonga very closely.

What do I do with FCA ? Do you have to get a reference or anything first or just send them a copy of the formal complaint and emails that we've sent

Just send all evidence you have so far, and throw a covering letter on it. You should get a case number or a thankyou for the info and it will be collated in their file.

Wonga finally sent their bank details after months of requesting them. Which I would guess is an acceptance of the amounts proposed.

This is what they sent. -

Bank: Barclays Bank

Sort code: 200605

Account number: 43637565

 

One question tho. They are reporting to CRA as late payment. How can we get them to show account okay or something ?

If they accepted repayment, then they should mark it arrangement to pay. Although they normally do this AFTER you commenced repaying them.

Still no reply to the formal complaint. No surprise there. It's been signed for and proof been printed off.

I also emailed back to the bank details asking if that was agreement to the payment offer, they replied with the same old email of 'call us' bla bla bla

 

Are they complete ejits ?

Yes, and they're still reeling from having to empty out their petty cash to pay the pocket money fine they had.

Perhaps they want you to call them so they can vent their spleen on you??

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Kept getting the "best to ring us" email and... log in to complete form although it was never actually there and I had already sent one from NDL.

Anyway after going round and round, they have emailed me today saying that they can not set up a repayment plan with me and to "ring" to look at other solutions.

I am ready to scream.

Hi

 

Just make the payment to them direct using your loan ref number/agreement number.

Send a formal complaint to them in writing, signed for.

 

Then report them when they probably fail to respond :)

Made the payment as agreed and it's come off the balance shown on their site.

 

But ...! Had email yesterday threatening a default ! With lots of terms etc, eg.

 

We're writing about your outstanding balance of £530.33 under the loan agreement dated 23 March 2014 between you and WDFC UK Limited trading as wonga.com.

 

If you have already agreed a repayment arrangement

 

If you have agreed a repayment arrangement directly with us or through a third party such as a debt management company and you stick to it, we will not file a default on your credit file. We will report such an arrangement to credit reference agencies and your credit file will be marked accordingly.

 

However, if you do not pay the instalments under your repayment arrangement on the agreed date(s), we may file a default 120 days from your original loan repayment date.

 

If you have not agreed a repayment arrangement

 

Please note that you agreed to repay this loan in full on 20 April 2014. As of today, the debt has been outstanding for more than 60 days. If you don't repay the amount owed within 28 days from the receipt of this communication, it is likely that we will register a default on your credit file with one or more credit reference agencies. This will stay on your file for 6 years and may affect your chances of getting credit in the future.

 

If we are unable to reach a suitable solution, it is likely that we would also take further action to recover your debt including passing the debt to a debt collection agency or selling the debt.

Now, would that be classed as harassment ? Considering since from before the due date we have tried to make arrangements with them but they have just been obstructive all the way with their constant 'phone us' and 'you spend too much in shopping in your I&E'

If its a dca acting on behalf of wonga then they cant do anything. Only wonga can.

Well, before they even consider issuing a default, they need to send you a proper default notice detailing what arrears youa re in and how long you have to rectify the fault. They cant blackmail you as they are doing in that letter.

Good point. Just asked my partner and no DN served.

 

So should I add into the complaint to the FCA? The email as an attempt of blackmail.

 

Wonga have also admitted to calling my partner today, as we replied to that email that we are paying the loan off as agreed and do not appreciate being blackmailed.

The formal complaint they have from weeks ago (must check date) specifically re states no telephone contact !! Email or letter only. So they have admitted ignoring my partners request again.

Not strictly true, they do not need to issue a DN on a fixed term loan prior to registering a default if the term has expired . They would I believe need to issue one prior to issuing a claim

Formal complaint has been with Wonga for about a month now. Maybe longer.

Is next step FOS and FCA ?

They should. Especially when they are borderline hinting at blackmail in the letter. It reads basically as " do what we say or we will do this".

3rd June you posted that you had just sent off the letter so almost at the 8 weeks. You can start the complaint with the FOS over the phone and then send in all the details

 

 

 

Just on the subject of AR markers a D markers, I think I would rather have a D as at least it is done with in 6 years. If you have an AP marker it will still be recorded 6 years after you have finished paying although it will also show settled

Yeah sent 3rd June. Signed for on 9th ( have the proof of delivery print off). So was 8 weeks Monday gone. They have accepted £20 PCM by email but still no reply to the formal complaint sent to them.

 

What action do we take now.

If you want you can escalate it to the Fos. Form can be found on the website .

 

Depends what you want to achieve

 

https://www.wonga.com/money/complaints/ That is their complaints policy. If however you feel there is an ICO issue you can send a concern off to the ICO as well

They've now defaulted her which has caused one of her credit lines to be withdrawn !! (Shout credit card, used to start building her credit)

 

What is the policy about defaults while a formal complaint is still outstanding ?
