CCJ and Defaults

Hi guys and girls my names Sunny.

Sorry to bore you with my life story. I desperately need a CCJ removed and 2 defaults removed.

 

CCJ was received last year I didn't go to the hearing or respond personal reasons.

 

I also had a default last year where I didn't respond personal reasons again.

 

I also had a default in 2011.

 

Although I have about four credit cards and two mobile phone accounts which have been ran excellently I know I can't get a mortgage because of these above debts showing on my credit file. I desperately want to buy a house. I understand I can have the CCJ set aside and I understand the procedure where if the CCJ is set aside then it will be removed pending a hearing and if the hearing is successful it will be removed permanently. I need some tips for this I haven't applied yet but I have the form n244 so I need to know the best way to get it set aside than at the hearing get it removed forever.

 

Second of all I have two defaults I understand these are more complicate but I guess its worth a try to get them removed and again if you good folks have any good advice on how to go about it.

 

 

Please don't judge me on how I got myself onto this situation because I just don't know but if I could turn back hands of time for the petty amounts I would not have let my credit report haunt me. I am in a better financial situation now but at one time it felt like I was on the poverty line. why do you think you can get the ccj set aside?

 

whats the reason please?

 

what are these accounts that have the defaults and ccj?

CCJ and the 1 of the default is for payday loans.

 

One of the default is from a mobile phone company.

 

I believe I can get the CCJ set aside because I genuinely thought I paid the money off

 

I had direct debits set up and they had my debit card details

so either way they could have taken the money.

 

I am also going to say I never received any communication until I read my credit report and noticed the CCJ.

 

I haven't contacted the court yet but when I do by filling in the form N224 I will be using those reasons.

No I've never moved living with parents.

you cant set aside a ccj just because the claimant had means of being paid and did not use them.

 

if the papers were sent to the correct address and simply ignored then no dice sadly

I didn't genuinely get the notice

they might have posted it to the correct address

but around that time I had a bust up with my parents

and I left to home to live with a friend for a while

 

I believe if it was sent then out of anger mum and dad would have either thrown my letters away

or would of sent them back to the sender stating I didn't live there.

 

few months later when I decided to look to buy my own place

I went to a specialist broker who could get me a mortgage with defaults but not with CCJ as it was fresh.

 

Thats when I got a copy of my credit report

noticed the CCJ on there and

 

I was wondering if I could have it set aside and getting it erased permanently after the hearing as I will pay the full amount owed.

 

I also was considering paying the defaults and try and bargain with them by saying if I pay off the money

would they remove it from my credit report

 

long shot I know but I can't think of no alternatives.

Two days ago you said you never changed address. Now you say you did.

If the court claim is posted to the last address you gave a creditor, it is considered served, even if returned or thrown away.

And you can't usually "buy" your way out of defaults. This is because they are intended as a reflection of what happened: a credit history can't be changed unless there was a genuine error.

Yes but I didn't genuinely receive the notice so on what grounds can I have the judgements set aside?
