      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi

 

i recently got a tv from buy as you view.

 

iv just had to stop working due to my health and can not pay it no longer.

 

i have depression exciety bipolar and the list go's on.

..but im so affraid of opening my door to tell the bayv man that ! im in a real state with it.

 

i wouldnt mind them taking the tv back as i know i cant pay and thats my fault

 

but he shouts at me and trys to walk in my home its making me nervous

 

i had to go to doctors to be put on diazapam just to try and deal with it.

 

im 23 and see no way out of this

 

please help me

 

he sits outside my house and

 

today he sat out their for 1hr 47mins while i sat in the dark crying

 

please im desprate

 

he said hes calling police

 

he shouts through my letter box and demands i open the door

and he has been caught by my naighbour previosly kicking my door to get an answer

 

i cant take this no more its driving me insane please help

You know what ..

 

. I haven't got anything with BAYV but there are a LOT of people saying their doorstep callers

keep using the Police as a pressure tactic.

 

Disgraceful and I hope the Police turn on BAYV for using such tactics.

 

It's a shame such "companies" have to exist but alas this is the world we live in.

 

I'm just glad it's so in the open for all to see -

 

- I'd NEVER even bother looking at anything BAYV after all the stories I've read on here.

 

The motto goes....

 

"What goes around, comes around" BAYV,

 

you will eventually pick on someone who will take you to task legally,

 

and by the looks of it, you will lose miserably.

Stephani,

 

if the bayv rep does this again, try and keep as calm as possible.

 

I know its hard.

 

call the police immediately.

 

tell them that someone is outside your home banging the door and making threats to you.

 

If he tries to stay there for an hour,

 

the police will easily come in time and move him on or arrest him.

 

The same applies for ANYONE experiencing this problem.

 

CALL THE POLICE IMMEDIATELY.

 

I'm rather concerned the BAYV poster hasnt suggested that.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I would echo the imp's suggestion. Call the police and advise that you are being threatened. If they try to say it is a civil matter, then ask to speak to someone more senior.

 

You MUST make a complaint to the OFT - they will not deal with individual cases, but they are obliged to keep a record and the more people report this type of behaviour, the sooner something will be done.

 

This truly is getting out of hand. These tactics of initimidation are simply quite disgraceful.

Are you able to see this guy's vehicle registration - make a note of it so that if he disappears before the police get there you have something they can identify him from.

I'm looking for a new TV, May have to pop to BAYV and pick one up. I need to try my new CCTV in front of my house.

You will be able to see that BAYV CEO Graham Clarke does not care about situations such as these... For example, in my thread, Graham Clarke and BAYV said they would seriously investigate my complaint and would also obtain a copy of the CCTV in order to view the attitude of their representative. The outcome of this is that I am still waiting for their serious investigation. However, I doubt if they will provide me with an outcome since Graham Clarke, the CEO himself said he would not make any further comment in my thread.

 

 

To the OP / Stephani - All I can suggest is that you provide BAYV with your account details in a private message on this site and deal with the complaint on the site. I would also suggest that you decline any suggestion by BAYV not to post on this site. By keeping your complaint public in this open forum, should BAYV actually respond to your complaint then there would be less chance of their intimidation tactics.

You could make arrangements to return the TV to BAYV. As for the harassment you have experienced, perhaps BAYV could also refund all the payments you made to them in respect of the TV since you clearly do not want to remain a customer of this company.

If I've given you advice, then it is just my thoughts / opinions - doesn't mean I am right!

I would suggest contacting elaine. Graham seems to fob people off.

Hello there, is there any further news?

has BAYV sent you a default notice?

How long have you had the television for? How long is the contract?

 

If you have only got the TV recently I'm assuming that you have not paid at least 1/3 of the contract. This means that the TV is known as an unprotected item. In a nutshell it means that BAYV can try and request that you give the TV back.

 

It DOES NOT allow for that individual (who is not a bailiff, but an employee with no further powers than you or I) to enter your property. If they mislead you as to their legal position you really must be complaining. Not only to the OFT as previously mentioned but to Trading Standards and the Financial Ombudsman as well.

Has this situation been resolved? If not, can I respectfully suggest that you immediately confirm that no further visits will take place with Stephani and request her account details so you can action such.

As you can see, in this instance, your customer has been informative about their depression and bi polar etc etc.

All I can advise you is to inform BAYV of your details, inform them that nobody from their company can call at your home unless it is prearranged collection for their TV. Alternatively, just deny them access to your property completely, and then send them their TV via courier.

 

Please will you update the thread if possible, firstly to let people know that you are OK and secondly to gain help in resolving this situation.
