Hi,

 

 

My wife has told me she received a N55 form(attachment of earnings order). I have discussed this with her and I believe we need to seek professional debt advice.

 

 

is there a way of delaying the due date (received before Christmas) so we can get advice? also where is the best place to go for impartial advice and help...?

Don't delay the completion apples (you have 8 days to return) or the court could impose a custodial sentence.

 

 

You need to rewind here what's the debt?...how old is the judgment?...did she defend or not? can she dispute the debt?

it was due to be filed on 25/12 notice is dated 17/12. (also point of confusion is a letter "notice of transfer of proceedings" also dated 17/12 from Northampton CCBC. how can this be transferred and form issued on the same day?

So you accept the debt ? If so complete the N56....with regards to the transfer of proceedings it may well be to deal with the AoE but with the scant information you offer its impossible to advise.

We accept the debt, so will be filling in the form. from your replies I take it there is no way of getting an extension whilst we seek professional advice?

Little point getting advice the judgment is in place ..done with....this is the execution by way of the Attachment of Earnings.You should complete this using the guidance notes.

 

 

You really need to find out why the matter has been transferred to your Local County Court and what their intentions are next? Is it with regards the AoE or the judgment or the none return of the N55/56....?
