Hiya

I am wondering if anyone can help. Sorry this story might get complicated but please bear with me as I have had enough and am making a stand!

We bank with the Abbey (aka Scabby in our house as we hate them so much but that is another story).

When I got this months statement in I noticed I was being charged £80 for going £13 overdrawn on the 2nd Oct

£20 for going over od limit By £1.49,

£30 for paying a DD of £10 that took me over my od limit by the above amount,

and a further £30 for another £10 DD taking me £11.49 over

and then £1.88 for interest charged while account overdrawn taking me to £13.49 od.

I phoned the bank and claimed that £80 was a ridiculous amount and would like the charges dropped. Now here is the rub due to no fault of our own and a business that we had used to fix our pram £499 was taken from our acc last month by "mistake" (banks and business' word not mine I would have said stolen). After a lot of toing and froing by my hubby (joint acc) all our charges were refunded, we are now getting this thrown in our face and told well you had £140 charges refunded last month so we can't refund any more! We got told a note would be put on our acc with words to this effect. After being passed about and having to explain the mistake/stolen money every time I was offered a refund of £30 which I declined as £50 is still way too much.I did offer to pay £20 as I do accept that we went over od but nothing was ever mentioned about it when I was passed around, have I shot myself in the foot? I then got passed on to their complaints dept who today have sent me a letter saying that all they are offering is the £30 refund and if I don't reply in 8wks time they will assume everything is resolved and will close the file.

Another thing that happened this month is that I wasn't paid. I am currently on mat leave after having two gorgeous girls in March. I had forgotten to send back my return to work form resulting in no wages being paid in Sept. If I had returned the form I would have been paid(currently signed off as I am absolutely shattered running around after 3 under 3) and we wouldn't be in this mess.Got my wages sorted and once all Childminders and other bills were paid, deposited the rest of my wages on the 4th. Have also explained this to the bank.

I am currently on the process of shutting down and paying off the od on that account and going elsewhere.

Where do I go from here? Do I send one of these LBA letters? As Isaid on mat leave and very easily confused by the real world.:confused:

Is there a copy of a letter I can write on here?

If I shut down the acc before the charges take place (3rd Nov) will they chase me or give up?

All help gratefully received.

PS just had a thought I have not actually paid these charges yet do I need to then claim them back?

Have read all the bits I think I am supposed to and would like to ask some questions before I start the procedure.

I understand that Scottish and English law is different and although my bank is the Abbey I am going to follow Scottish law insted of travelling.

My questions are this

Which letter of S.A.R - (Subject Access Request) do I use the one from the library or the one from the Govan Law centre? I would prefer to use the one from the library as the Govan one is confusing to me.

Once I have handed in the S.A.R - (Subject Access Request) at my branch and obtained a receipt they then have 40 days to send out the last 5 yrs accounts. Using the spreadsheets provided by Vampiress (thanks) I then work out what my charges have been. Once I have done this I send the prelim letter for refund along with spreadsheet? and allow 14 days for a reply. After this date send the LBA and another copy of spreadsheet? and wait a further 14 days.

I think it is at this point the Scottish and English law split, am I right in thinking this? I am then off to the courts if there has been no luck by then and can use the advice can by Scotia in the thread Scottish procedure.

Sorry if I am repeating information already here bit I have spent the last week reading all the info and my head is now mince.

Someone from East kilbride replied to one of my earlier threads with all the Scottish links on it, I can't find my thread or the EK user. I will post in the Abbey forum once my S.A.R - (Subject Access Request) has been handed in to keep a track of everything.

Once again thanks for all help. I have been told to post this here also as you will be aware of all the tricks that they use.

Hiya Nathal,

Thanks for your input.On the Scotland page( go to general and then you will find this ) the Govan Law Centre have supplied information with regards to the Scottish system which is what I will be using. Also as I am in Scotland through reading posts on here I understand that you can only go back 5 yrs. Hope that helps.

i would advise you to stick with the templates from this site

and stay on track as regards timescales

 

on request ask for statemnts to cover full banking history

 

apart from that spot on
