      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I hope money belonging to the UK has not been overly exposed to lending cash to Greece. Was it Goldman Sachs who were paid money to complete a report as to whether Greece complied with the criteria to join EU. Not sure how they managed to get a yes on that as like some of us who have previously posted on this issue, would have said they don't fit the criteria. Must have been another reason for entry, lots of armery maybe? Who knows the name of the game.

 

 

Keep hearing the murderers in Tunisia were on the radar. Once on don't take off, or ignore. We all need to be vigilant as we go about our business as the murderers are always looking for opportunities.

 

There was a strange man arrested in Watford in the last month dressed in a Burka carrying an unexploded device. I haven't heard anymore on that. Someone noticed he was acting strangly and it was acted upon. I've also heard there was an anti western protest march in Luton ystday.

Had a discussion on the internet other day with an American going on about how bad gay marriage was

 

After pointing out that there are other topic that deserve the attention more and are more of a risk to civilisation than gay marriage. After all, when was the last time a gay person detonated themselves for the so called Gay Agenda" or Flew planes into buildings or committed mass murder.

 

Agreed that those who actually harm people with hatred should be the target of our efforts than those who just want the opportunity to love like anyone else

For me two main reasons why Tories won election, reliance on personal image of leader, personal jibes towards the opposition, promoting a presidential image to impress and the other reason frightening people big business would leave the country and your jobs would be lost if Labour were elected. Perception is key. This country is great in many ways, not perfect but when it comes to assets being safe, you're not going to get a mass exodus of business. They could lose everything in other countries! Perhaps an idea to have a referendum on making your vote count to give fairness of representation. Maybe George O is next for leader, previously I thought Oliver G.

 

News report we are at the same level of alert as Tunisia.

 

Greece need to kick start industry and produce for themselves and export, a plan for this first and then the talk of bailouts and pay backs can be considered. As it stands it's a black hole for cash but Brussells don't want Grexit as it then shows a union fits all doesn't work. A big conundrum.

There was the Scottish scare mongering as well, for me that comes under my umbrella of business leaving Uk partly because of the Scottish factor and comes into my reason of perception, perceive Scotland as the enemy. A call of join me to defeat them. Could be seen as racist?

There's no room for cut backs so the country needs help to rebuild it's economy in a credible way and make the EU feel they have confidence in Greece to do this.

Raising Fox Hunting again has angered and embarrassed many Tory supporters. Their view is there are far more important issues which need to be addressed and gives the impression the cabinet doesn't connect with the electorate. It brings back that Tory Boy image. The next thing is trying to force thru English votes for English laws, so they can force thru the Fox bill. I believe the people will begin to see what's going on with the blues in power and begin to embrace the SNP.

Transport workers told to work 24 hrs. This will eventually be embraced, but the government made it look as though it was an outright refusal by the unions, for obvious reasons. There needs to be more discussion as to how this will be implemented but the bullies can't be bothered with that part of the equation. Now, surgical staff have been told to work weekends. With this implementation, people will see how these reforms take time to put into place, and not that train unions are purposely difficult. The government just want people to have that perception.

 

MP's just awarded 10% pay increase. So there is money then. There is also a long recess in summer. A world away from workers just trying to get a fair deal, work life balance.

Thought of a new thread, but probably better here.

 

Have the public become too use to high death counts in accidents reported and it is no longer major news ?

 

Over the weekend we had the air show plane crash which has killed up to 20 people on the A27. It has been the first item on the TV news and is covered in newspapers, but it is not the big news story it would have been only a few years ago. A few years ago, we would have had continual news coverage and normal TV programmes interupted to break the news. Now it is just one story.

 

I think this terrible disaster will be the start of a discussion as to whether air show acrobatics should not take place over land. I sense this tragedy will be expanded upon this coming week.

There's been reports in the past on this drug but I believe everyone should be aware of it's existence, and from what I hear it's on our streets. Do we all remember on the news a short while ago, a small shop owner is seen handing over his wallet to a man who was a thief. He seemed to just walk in, 'hypnotise' the shop owner and the wallet was handed to the thief. We didn't hear any more of that incident but my guess is it's this drug which was used. If a small amount of the drug dust is blown at you, you comply with whatever is asked of you and you lose memory of what happened whilst under it's influence. Maybe there should be an advert campaign, what happens in clubs and bars comes to mind and any citizen caught unawares.

Yes UB. They're trying to discredit JC but imo it aint working!

 

We are really starting to see the true colours of those we thought really cared. I was disappointed to hear comments from a household name how we may as well live in China if JC elected. How ridiculous. This person thinks JC will rock the markets. The only people rocking the markets are those who peddle grim gossip which shallow city dealers use for their own ends. Challenging hefty rents and runaway house prices is a positive move, even for investors. If you don't address these issues, there will be empty property eventually, your portfolio is only as lucrative as those willing to buy or rent. Too much greed will desseminate that.

Reading the Syria thread. So it's all about World dominance. I wonder how these countries who want to hold the west to ransom will appreciate not having their luxury goods, BMW's, Mercs, Rollers, Range Rovers, Ferraris, Bentleys, Gucci, Chanel, Mulberry, Louis Vuitton, Champagne, Scotch Whiskey, etc etc because I don't see them producing similar for themselves. If they tinker with gas pipelines these goods won't be so available to them in more ways than one. They need to all calm down and talk sensibly.

 

The Desert is getting bigger so I would have thought you would want as many friends as possible to help sustain life in such conditions.

Reading the political threads on here, just shows the skulduggery all around. No one person takes the UK to war so money spent on enquiries I believe will never reveal the whole truth.

 

I hope we are not witnessing another cover up of abusers where the police and others are being undermined in their investigations into the truth. This is not encouraging people to come forward, as it is showing how witnesses are being discredited, how convenient for those who are guilty.

 

It seems houses coming onto the market for average home buyers have a high probability to just be another addition to a portfolio somewhere. These investors make it their business to find the bargains, very friendly with estate agents, closely involved with developers, all this making a house purchase more difficult and forcing the country into renting. At least overseas investors can't take the property back to their countries.

 

I fear we are being dragged back to the 80's again, Lloyds's shares up for sale for all, sound familiar? Bringing down public institutions so privatisation is inevitable, feels like so much will be owned by so few. We must make sure they don't start feeding the livestock dodgy stuff.

When has it ever been the case to pay tax on tax; silly me petrol duty has VAT on it.

Oh dear, I only got 1% pay rise this year says the rich man; tell you what I'd take the 1% of your £1 million salary over my pension rise anyday.

We're all in it together, RUBBISH. Percentages don't work, want it to be a fairer society give every working age person the same pay rise of only £1000 a year capped for life and listen to who moans the loudest. Yes you guessed it, "The people who aren't in it together."

Fat people, druggies and alcholoics clog up the NHS, strange the last time I was there I felt old age should be banned and anyone playing a sport should not be let through the doors. The National health is there no matter who or what, can you say that for BUPA! The rich always use the many as their safe guard.

When I was young and every thing was Nationalised, YES the didn't make money; everybody did!!! and I owned it. Strange when everything was sold off I never got my cheque, did you?

The latest energy saving, money saving devices go into the newest devices for the people with the most, who can afford to buy them saving them even more money. The poor who cant afford solar panel and new car with zero road tax pay through the nose for everything using more so paying more with the smallest pay rises.

 

Ever wondered why the rich poor gap is getting wider.

 

Change starts with a single person, if only we could stop the rich killing that person off, oh yes, forgot, that's what we call politics. The party system is designed to stop change, only a Nuclear war will change anything now.

 

People forget greed is bad!

When you read this stuff it makes you feel all we are succumbing to is being a playground for the rich. If there is all this dosh swimming around in our economy, why are we all always being made aware of charities needing money. I watched a programme this morn where a wheelchair football club were trying to raise money for more adapted wheelchairs to enable more participation in the sport. When you think of the wages in premiership football, endorsements, sponsorships etc, let's hope the club get their cash quickly.

With ref to the Lottery, Camelot say the winning ticket bought in Worcester. If they have ascertained this, which can't be hard as all info on their system, how can other claims be bonified? I would expect them to know the shop it was purchased the date and time, from that CCTV can be checked if was working. We are told only two tickets won so how can hundreds of people claim the same? Were there hundreds of winners then:madgrin:

I believe the Treasury Select Committee is keeping it's eye on the FCA, as the consumer champion ousted by George has been replaced by someone who is said to be more swayed towards the other direction. We shall see.

strange as now read on Yahoo that the woman who first said she has the winning ticket has to wait at least 180 days before any pay out?

 

Well, she won't have to wait that long to find out now!

 

As I see it, the rightful person chose not to come forward for their own reasons, but has done so now.
