      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone.

 

Just after some advice about how to reclaim the OSC on a TV I've got from Perfect Home.

 

I took the agreement out in January 2010.

 

I requested an up to date statement of my account which arrived in the post on Saturday,

and immediately noticed that I have been paying OSC for the last 3 years, despite the fact that I clearly asked for it to be removed.

 

When I spoke to the staff at PH, they said that because I've paid the OSC for the last 3 years without question,

 

I don't have a leg to stand on.

 

Where do I go from here?

have you done a spreadsheet?

you are entitled to 8% stat int

as they have deprived you of the use of this money

 

you need to put every payment individually into this spreadsheet.

 

 

This first spreadsheet is the latest version of the statutory interestlink3.gif calculator and is used for Single Premium PPIlink3.gif cases. It can also be used where rollover PPI is involved, i.e. a new loan re-financing a previous one and where PPI is included in one or more loans. It can also be used for S69 redress calculation on any sum, like on a closed/frozen interest PENALTY charges claim.

if you can identify that they have charged you interest at their rate

then things are diff.

 

I've never seen a PH statement so I don't know.

Just the OSC premiums - can you use the following method to post up your statement it is a little unclear as it is.

 

 

Dx100 – Instructions on uploading pdfs

Scan the required letters/agreements/sheets

as a picture file

remove all personal info including barcodes etc. using paint

but leave all figures and dates.

Go to one of the many free online pdf converter websites

convert the image to pdf format.

or if you have PDF as an installed printer drive use that

open a new message box here

hit go advanced below the message box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB: you can set where it goes in the post by hitting insert inline.

Then hit reply button

right so the osc/dlc or whatever is the maint vouchers £863.26

 

and they are charging interest on it!!

 

you pay £6.64PCW on the ins+int = £1321.12

 

so you use the statint sheet

 

and enter £6.64 every week you paid them.

sadly no as its not a penalty charges issue

nor

is it PPI

 

however, you could 'generally' base it on a ppi reclaim.

 

can I suggest you have a browse of this buy2own forum

 

and see what others have sent to any of them.

I am writing to inform you that I am giving the required 7 days notice to cancel my premiums for Optional Service Cover.

 

It has come to my attention that at the time of taking the HP agreement out, I was not informed of what OSC was, nor was it explained to me that it could be cancelled at any time.

 

In respect of this I would like a refund of the premiums paid since 11 January 2010, a total of 192 weeks at £6.64 per week for OSC. This is a total of £1,470.87 including interest at 8% per annum which I expect to be refunded to me within seven days.
