      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have been pursuing Abbey for £2624.89 on behalf of my son, have sent the standard letters and issued summons. DLA Piper on Abbeys behalf have filed a defence but made a offer of £1432.44. On the same day Abbey complaints sent two letters 1) we are still investigating and 2) a goodwill payment of £1137. They dont talk to each other. Rejected DLA Piper offer unless it was in addition to GOGW but did not get a reply. Now Abbey Complaints want their mony back after we spoke with them. Now Abbey Legal have taken the case from DLA Piper, not yet established any meaningfull dialogue with Abbey Legal. Have postponed the Court Allocation Questionnair whilst awaiting a response from Abbey legal.

 

Between them the don't have a f****** clue what going on.

 

Help where do we go now, will Abbey make another offer or is it see you in court. Can they take the GOGW money from my son's account.

I would suggest completing ad returning the Court AQ, don`t delay just because Abbey can`t get their act together.

It is strongly felt that Abbey pulled the plug on DLA Piper as a further attempt to delay claims, and by bringing legal inhouse I`m sure they are expecting courts to allow more time for them to get up to speed with cases.

My guess is that courts will see right through their ploy, and dates will be set to hear cases as normal.

If you complete the AQ then Abbey will know you mean business, and will be more likely to settle sooner rather than later, if you delay in returning the AQ you could be just playing into their hands and they could keep you waiting for even longer.

I agree with Armsoft, get the AQ in. Do not worry about what abbey are doing, just worry about getting your money back. The courts are not stupid, they know the score, they do this every day of the week. Abbey are not going to defend, because they can't, end off story.

Sorry long time giving an update

 

Abbey Legal advised Abbey Complaints not to claim back the £765

 

Wrote to Abbey Legal regarding the claim, no response

 

Filed court allocation questionnaire, allocated preliminary hearing for 25th Jan, still no response from Abbey Legal.

 

Contacted by Abbey Legal 8pm on 23rd Jan by phone (must be in a mess if working at that time). Abbey offered to settle there and then initially for a further £1600, then for the full amount. Delivered letter to court by hand next morning, saying Abbey had settled. Did not appear to get passed to the Judge as he struck the case out on the 25th for non appearance by both parties. Abbey paid cheque into sons account on the 24th (made hom wait for 5 days for it to clear)

 

Thank goodness we have reached a satisfactory conclusion, 6 months, but more importantly a lot off stress.

 

Good luck to all those pursuing their bank, don't give up, you will win in the end

Hello all, I've just found out about the possibility of claiming our charges back! (where have we been!!!!) We were banking with the Abbey, but have now closed the account and moved bank 6 weeks ago, we do have all 6 years worth of statments (sad I know but may be useful.) We have calculated the charges at £4038. I am wondering where to start the claim and as i'm a member of a 'Law club' I am wondering whether to deal with this through them to take the stress away as Abbey seem to be 1 of the crap banks to deal with? I would appreciate guidance, thanks.
