Since joining this site with regards to a debt company chasing me I decided to go through old paperwork

 

I found Midland bank credit card statements from 03/94 to 07/97 where they had been charging me Cardholder repayment protector.

 

I defaulted on this in 02/97 as I put my business into receivership. I told them I was out of work and the continued to charge me interest and late fees until the debt was taken over by a debt company. I then did a deal with them and paid it off over the next 15-20 years.

 

What I now realise is they never offered to pay out on the protection they charged me. They just stopped adding it to the bill for the last few months but kept adding interest.

 

What is the best way to go about claiming and what could I claim for? I was a director of a LTD company so in my opinion self employed? If not why did they not pay me when I was unemployed.

 

Do I send a SAR letter or just claim against them for miss selling. Are there any templates I can use.

Also if they have sold me this insurance and never advised me to claim, can I not claim back the 12 months payments they should have made? I defaulted at £4286 but by time went to debt agent ended up £4865. Which I paid off over a long time. So I am thinking they owe me more than just the PPI. Does anyone have an idea how I should word the letter and also what should I send them to prove what they charged me

Would I need to do A SAR if I have all the credit card statements?

 

What will the SAR show? Will it show all the info that the debt agency had as well or would I need to write to them as well. Annoyed had insurance but not told to claim. So ended up with a £1000 more debt where as the debt should have gone down while insurance paid out.

Dear Sir Madam

 

I had a credit card with Midland card services from approx 1993. I have been going through my statements and have realised I was charged Cardholder Repayment Protection on this card. These amounts varied from month to month.

 

I became unemployed approx early 1997 and wrote to yourselves asking for you to accept a payment plan and to freeze charges /interest. But you continued to charge me the protection and the debt rose from £4200 (approx) to over £4800.

 

I finally had debt signed over to a debt company and set up a plan which I paid for many years till it was cleared.

 

I am very concerned that I was charged a protection charge but never offered to actually claim. Surely if I had been offered advice to claim then my debt would have been covered while I was unemployed and instead of continuing to increase it would have actually decreased. This in turn would have helped me cover other debts and pay them off quicker with less charges as well. Why would you sell me a product but then when you knew I was unable to pay never advise I could get financial help?

 

These were a very bad few years for me and because my debt rose it took me many more years to pay. I also had letters from your agents threatening me with court action and charging me £132.75 for the privilege.

None of these charges should have been added and you should have been paying my card not charging me more money.

 

I will await your reply before forwarding my complaint to the Financial Ombudsmen

I know I can do a standard PPI claim but to be honest I only paid £500. I am more concerned about claiming the money they should have paid when I was out of work and also the money they charged while I was trying to set up a plan. I dont want to send in a standard PPI claim and get back £500 as because of not advising me to claim I am out of pocket by about £2000. So not sure if should send in standard letter. I have all letters from them with regards to getting a payment plan into operation but not once did they advise I had protection
