Problems with conveyancer

Hi,

 

Wonder if I can get advice.

 

Purchasing house from Brother. Price agreed. mortgage agreed and offered. Conveyancer appointed. Property valued. Searches completed.

 

So pretty much near the end of the process.

 

Last week I complained about my conveyancer to the head of department at the legal firm.

 

Reasons:

 

- she lost my ID

- she lost paperwork which had to be resent by lender.

- she would not give me details of where we are in the process. She would only offer me answers such as "presume", "assume", "think" etc

- her answers were abrupt and she was very unprofessional.

 

 

Following complaining she sprung into action but I now think she has taken the approach of being quite 'bloody minded'.

 

Searches are all completed and she has then sent a letter of 17 questions to my brothers conveyancer of things such as:

 

- when burglar alarm was fitted and requiring Certs of installation (even though there isn't one which is clear on the fixtures/fittings.

 

- she has stated that she finds it suspicious that the property value has risen £40k in 12 months...... It was a repossession, fully rewired, full new heating system and state of the art boiler, fully renovated, new luxury kitchen, new luxury bathroom, sliderobes etc etc + in the area which is very sought after prices have just risen and risen. It's fully in line with similar properties in the area and the lenders valuation too.

 

- she requires Certs of electrical work

 

- she requires Certs of heating install

 

 

And much much more.

 

All of this can be provided but she states as follows:

 

- I am not sending certificate of title until I receive the above.

 

I have made enqs with the lender who has stated that they are not remotely interested in seeing the above because they are happy with their valuation. They also state they aren't bothered about the certificates as its a residential mortgage and all they want is the cert of title.

 

I've raised this with the damn woman who has said:

 

- I WILL MAKE ENQUIRIES AS I SEE FIT

- IM ACTING ON BEHALF OF THE LENDER

- I WILL NOT SEND THE CERTIFICATE OF TITLE UNTIL I'VE GOT THIS.

 

 

I'm extremely angry and wondering if I'm justified or is she correct.

Sack her, this is the problem not using a solicitor.

You instruct her not the other way round!!

This is a solicitors firm. I may have confused the issue. I'd name and shame the firm but don't think it's allowed.

No problem in naming them at all, is the conveyance a solicitor?

Even if she is YOU give the instructions NOT her!!

Thought that might be the case, personally I would be complaining to her supervisor, you have the information that the lender does not have any interest in the data she wants provided.

It all comes down to the simple fact YOU INSTRUCT THEM!!!

Well I complained to her supervisor who is head of dept, last Monday because she had done bugger all and was bordering on being quite rude in her responses.

From Tuesday she started doing lots but her attitude wasn't much improved.

 

Now she's being an a**e and being as difficult as possible. It's as if she's taken the attitude of

 

How dare you complain about me. Right then I'm going to do everything to the nth degree and make life difficult.

 

If I'd not already paid them a sum of money I would get a new solicitor.

My other concern is that by complaining last week it didn't help and if anything she became more awkward.

 

It could all get worse

I agree however....

 

I'm purchasing from family and know the property and area very well.

 

I'm happy with the price and works completed. I'm not bothered

In getting responses on her questions. The lender isn't interested in getting responses on her questions either.

 

However, when politely raising this with her comes the arsy reply of

 

- I WILL ASK QUESTIONS AS I SEE FIT AND WON'T BE SENDING THE CERT OF TITLE UNTIL I GET THE ANSWERS.

I understand that but I've explained that I'm just interested in her sending the cert of title to the lender so we can exchange contracts and set the completion date. This way I can arrange removals and give notice to my landlord.

 

Having explained that I know the area, property, works carried out should just let her act in my interests and wishes and sort the matter.
