      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

At last, congratulations hillards, most of my money has been spent, paid up credit cards and some debit balances on utility bills - but it feels good, did not want to waste it. Enjoy your visit to the Halifax, now you can relax and perhaps find a new target...........

Oh what a performance...

 

I took the cheque to my old branch and presented it at the counter, only to be told it had to be paid into an account??? What a load of rubbish, it was a bankers draft and, as far as I am concerned, is as good as cash.

 

The counter clerk called her supervisor, who also said it had to be paid into an account. Cue ever so stroppy attitude from me, and quite loudly said "well if your head office had not closed my account I wouldn't have had to come in with a bank draft cheque like this".

 

They went to find their boss, who had to make a phone call. No idea where to but they eventually came back to ask me for the letter that came with it, and to ask for ID.

 

They had to mess about on the screen to enter in some details, to pay it in, then pay it out, to an interrnal account of some sort. Then they did a counter slip for me to sign to say I had recieved it.

 

Finally got the cash! Also went to open a new account with the Co-op Bank. Waiting to hear about that now.

 

Next week I start on my Halifax credit card...

GREAT Fantastic news, I am pleased that they sent you a draft and that you were able to get it cashed. I would have been inclined to advise them that you were prepared to get the press involved had you not been able to cash that draft.

I do hope that you can get your new account opened soon and Good Luck with your next claim.

Just sent my rejection of settlement letter off, so they've got until the 13th January to get back to me or it's court!!!!

 

Although I cocked up big time and forgot to send it recorded delivery, I've posted about that though!!!

Would have love to have been in the building society, you have every right to feel p.off - I think they have led you a merry old dance, but you have got the last laugh.

 

Do you know what to expect when you claim for your halifax credit card - was thinking of doing hubby's, only thing stopping me is that we don't want them to withdraw the facility especially now we have paid it all off. I'm sure it's not much but there have definately been charges, what do you think?

The Hx Credit Card will be a slog for no actual return I'm afraid. Anything I manage to claim will be taken to pay off the balance, I already know that much.

 

That's not going to stop me going ahead with a claim though, may as well get a couple of hundred quid, or whatever the amount turns out to be, reduced from that account.

 

It's in default and I can't pay it, so this is about the best I can do to reduce the balance.

 

It will be the same for my Capital One and Citi cards, when I get that far. I didn't take them out with intention to default on payments, but losing my job was a big blow last year and I've had to set priorities here. Food and home come first.

 

My credit status will be dire in the near future, as I've defaults to come for those two cards as well as the one already on my record from the Hx. It will stop me getting credit for some time to come, and I feel that's a good thing right now!

 

As far as your own claim goes - go for it. You may as well get back whetever they took off you in charges.

 

Looking at the latest 'news' around the forum on the Newark/Lincoln court statement I feel that the banks are not going to be messing people about as much in future, as forcing customers to file at court has upset at least one judge!

hillards, ditto to above. Also whatever you can take off credit card will be a good thing, got to take a postive out of it. I am also doing capital one, starting this week for hubby and I, we no longer have our accounts with them, but hey lets get those charges back. Are the halifax credit card threads in this forum or separate?

13th December is the date on letter with acceptance form which was sent the same day, 1st class recorded.

 

I rung up last week, and spoke to a Doreen Johnstone. She told me I should have it by end of week (that was last week!)

Im hoping I will receive it today as I am desperate!!!

Congrats on finally getting your cash Hillards. Keep going with your other claims - I know you won't actually see the money but a moral victory might give you a bit of heart. I am hoping to get my money in my a/c by the end of this week. I am then going to go for an Early Redemption charge against the Halifax - I never knew you could until I read other threads on the site to do with ERCs.

I also had a 2nd charge mortgage that I managed to sort out last year, but had incurred some horrendous costs & extras. I will now try and get some of this back as well.

This was with a less well known lender who really took advantage of the fact I had a poor credit rating and hit me with a disgraceful interest rate.

I was very vulnerable at the time but it was the only way out of the mess I was in at the time.

All I can say is keep going and keep your chin up mate, your victory against the Halifax is hopefully a sign of better things to come.

Just noticed I've got a reputation credit which says "she talks a lot of sense". Was I really wearing that dress when I wrote the thread?

 

I'm usually male, but if you can see what I'm wearing sometimes I can understand the confusion LOL. Remember the advert where the guy is sat on the railway platform, with a sign saying "At weekends I'm Mandy" ??

Well done Hillards. My OH is from Conisbrough bless him. Just about to issue for him on Friday will claim contractual on that though which takes it to £13500 give or take. Ive issued for the credit card sent in request for Judgment today and an LBA for an account I had for 9 months where the charges still amount to £430! The standard letters are really irritating and the way they say if we do not hear from you within so many weeks we shall assume you are happy makes me want to write back in words of 2 syllables

Just got my new bank account info through today, waiting for a paying in book and the debit card now. Then I may be able to transfer some money to CAG as a donation at last.

 

Been a bit of a swine not being able to use a card for shopping and everything of late, I don't like carrying cash around if I can help it. Even more annoying that I've missed some bargains on eBay, I can't fund my PayPal account until I've got a debit card again.

Although I've yet to send the SAR, here's my new thread: http://www.consumeractiongroup.co.uk/forum/halifax-bank/55162-old-dj-halifax-one.html - I've had to wait for the Hx to pay up, then open a new bank account, and should be able to get that under way this next week.

 

I will be midifying the SAR as I require a complete set of ALL information they have on that account, not just the statements. I am keen to see what they've got on file with their on-screen comments following various telephone calls they've made to me in the past, before I stopped them doing that, plus a record of the calls themselves so I can see just how excessive they became.
