I have just received a letter from P&J Debt Collection Services

threatening me to proceed with immediate legal action to recover a debt due to Bank-Smart

relating to commission charges for my PPI settlement.

 

they write that a court judgement would mean that i would be responsible for legal costs & court fees

in addition to the current amount owing.

 

It is not that i dont want to pay Bank-Smart,

but i have tried to contact them as i disagree to pay the full amount as i was the one who had to chase LLoyds TSB

for the reimbursment of my PPI.

 

Bank-Smart did not do anything at all apart write them once and that is all!!!

 

I did send them an email which they reply that i had to pay the full amount, why I was the one who has done their work not them.

 

I have kept all time and dates that i had to chase Lloyds..

 

. I have read that Bank-Smart has very bad feed back.

 

what should i do with P&J and Bank-Smart.

I am very worried now. Can someone help me please. Thank you.

dca's are not bailffs

 

they have NO SUCH LEGAL POWERS

 

IMHO I agree with you

bank smart did stuff all really.

 

i'd ignore them.

 

no PPI CMC has ever gone to court for 'speculative ' fees

esp as you did most of the work.

 

a good lesson to everyone

 

you don't need to use ANY CMC to get PPI back!!

 

do it yourself for FREE

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thanks Dx, so you think they have got no ground, they will not take me to court? I will ignore them but i just want to make sure that they cant do nothing, according to them my husband did sign their contract & terms !! gigilafab

Just to pick up on DX point above

 

I am aware of at least two PPI CMC's who have taken court action and obtained CCJ's for fees on more than one occasion.

 

However I doubt that a CMC using a third party DCA is likely to be one that will take such action.

 

Without going into the merits of using or not using a CMC,

the key issue in your case is that you have instructed one and they have done a poor job.

 

My advice would be to raise a formal complaint with Bank Smart explaining the reasons for non-payment

advising that you will escalate the complaint to the MOJ if you are unhappy with the response.

 

In the unlikely event that it does go to court, you will have evidence that there is a dispute over the services they have provided which forms a valid reason for non-payment.

I suspect I am about to do battle with Bank-Smart shortly.

Foolishly, before becoming aware of CAG I signed one of their agreements.

They have been pursuing a loan company for the reclaim of PPI (which never existed) but not gone for the charges that I understood they would do.

 

Does anybody know of any history of successful claims by Bank-Smart against their 'Clients' for payment of fees when they have been unsuccessful in getting any monies for said client.

 

I have told then there is no PPI to claim and that to pursue such a claim would be fraudulent. I await their ire.

Oh dear now I'm panciakinbg as intitally for my HSBC claim I used "I want my ppi back"

but when they got the refusal I then emailed them to let them know that I was now taking over the matter and going to the FOS.

 

I have emailed them twice and rung them but have not had a response.

 

I really think that the FOS will upholad my claim but that is after me writing to the bank,

sending a SAR and sending in the complaint myself to the FOS.

 

Do I need to get it in writing fast that IWMPPI are not dealing with this

or how do I cancel the agreement that I signed with them last year.
