Letter was sent but today I receieve another one staying that Capital One are digging the agreement out of their archives, though I've already send a failure to comply letter.

That's fine they have not supplied so the account is disputed.

Another quick thing, the default down on creditexpert for this is labelled as Lowell and not Capital One. Is this correct? I don't even remember getting a letter or anything saying that default will go onto my file so does that mean if they never sent one that I can legally get it removed?

 

How does this work?

I would guess lowlife inherited the org default.

Lowell must have purchased the account then, if you have not had notice of assignment you can tell Lowell to go forth, you should place a notice of dispute on the CRA files, (check the other agencies too).

 

You will have to complain to the data controller at the Lowell group.

They have now sent me the contract from Capital One but it's already past the date so is disputed, so what should I do now? Ignore it or send them a letter reminding them of my failure to comply letter?

Another letter saying they are collecting statements.

 

Do they not understand my failure to comply letter?

 

What should I send them now?

Well I got the statements about 2 weeks ago.

 

Just got another letter saying that because I haven't responded to them, it may result in further action to be taken. Are they just ignoring the fact that I sent them a failrue to comply letter?

 

Ignore this one?

Is it worth writing to them to see if they would remove the default if i settle in full? Though there is only 11 months left, but was hoping to get a mortgage next year, but will these defaults staying around until next year and some the year after, I'm not so sure?
