On JSA - 9 Payday Loans - Help please

I`m on JSA and have 9 Payday loans Ive had to list them because I could not remember who they were with. I said to myself when I start to default then I will start posting on here for help and which letters to use.

 

I have read numerous post on here and I have rememberd some advice for other people.

 

So I went straight in there when I started to default and send emails offering £1 a month and ignoring phone calls. Wage Day and the Loan store seem to have excepted the £1 a month payments but Ive asked them to confirm it and I will send a standing order of £1. PayDayUK have been reallly good as they accepted the £1 token a month and gave me their account details and reference without me even requesting them.

 

 

I know I will need advice especially with quickquid, minicredit and Payday Express and CFO as all they did was ask for proof of unemployment and a quick budget I/E which I did because I had nothing to lose and I made sure personal info was blocked on the JSA letter such as NI ect.

 

All Express and minicredit seem to do is send an email saying I`m in arrears and need to speak to me over the phone (not gonna happen) CFO sent a stupid email saying they can`t accept a repayment plan until after 33 days then it goes into phase 2 when I can sort out a payment plan until then they will continue to try and take money out of my account and keep on calling. QuickQuick said they will try to take money out of my account until we come to a repayment arrangement or it guess passed on to a third party and I received my very first letter today. First letter after a month so excited I was.

 

By the way the house number they have turns out it is incorrect and it will be cancelled at the end of this month and they can ring day and night on my mobile the only numbers I answer are the ones I recognise or local numbers. I have answered paydayexpress but I never said anything I just listed but they were silent to.

 

Plus can anybody tell me if it went to court and say baliffs were ordered (I know we are along way off anything like that) would they be really be able to come round to take things as I am living at my Dads and not a single thing in this house is mine its all payed for by my Dad even the bed I sleep in.

They will not be able to take any property that is your Fathers.

 

In fact it is unlikely it will ever get to the stage where a bailiff is instructed. The court will almost certainly take into account your circumstances and order you to pay only what you can afford - if that is a £1.00 then so be it.

 

I think you should try and avoid thinking so far ahead.

Just to note, Bailiffs will only EVER be called when a judgement has gone against you, you dont pay the debt, you go back to court, a judge doesnt believe you, then go through attachement of earnings or a deduction of JSA etc ( £1 a month), and even then its very very VERY unlikely bailiffs will ever enter the scence. They are only ever really used if you tell a judge you have no intentions of paying.

iI wouldnt worry too much.... they cant force u to pay them if u havent got it. They will call/text/email/ send letters but if any of them went to court, the judge can see u cant afford it so would, providing you keep evidence you offered to pay 1.00 a month, week, whatever...they should rule in ur favour and u will end up paying them 1 a month anyway. silly really.

ME: the paid holidays are from the beggining of the year to the end with 28 payed holidays in total I never used them so feel I`m entitled to them

Loretta: My apologies we do not know of 28 paid holidays for the UK.

ME: I have too many debts that have all caught up due to me not working and can only pay you £1 a month until my financial situation changes and I start working again in which case I would then inform you of that asap and start offer larger amounts and hopefully even manage to pay off the remaining balance. If I do receive any money and can afford to pay off the loan then I would do it in an instant

Loretta: Please be advised we will no refuse any payment, however we cannot secure a valid payment arrangement of £1.00 per month as it is not a valid payment arrangement.

ME: what is the best option for me to do because I really am down to bare of everything at the moment everything has just caught up and I`m trying to get things sorted one by one

Loretta: My apologies but I can only assist you with your defaulted balance. I cannot offer or accept a payment arrangement on your current loan.

ME: at the moment thats all I can offer and when I do get back on top of things financially and can offer larger payments or even pay the loan then I will do so I`m trying my hardest to get back on my feet and start work again

Loretta: Regrettably Chris I can only suggest to contact us when you have funds available as £1.00 per month will not secure a valid payment arrangement.

ME: ok I will contact you when I have funds available will I be able to make a token payment of £1 as I really want to at least try and pay something or would that be a waste?

Loretta is not very nice. Nicest one is Antoinette, but Rachelle SEEMS more understanding when dealing with these ppl.

 

OK Next step is to go to Citizens advice! You have many loans and u cant afford to repay full amounts for each loan.

They will set up a reapyament plan on your behalf for all your creditors, so basically, you will make 1 payment every month to the plan that citizens advice put u on...and they pay all ur creditors.

 

All i advise you, is do not panic. But to make sure you face it head on and not ignore it.

 

Youre on benefit, and economy is tight now so if it ever came that you had to go to court, the judge would see you cant afford to pay everyone in full, and would most probably rule in your favour as you are willing to pay , no matter how little the repayment is. Make an appointment with citizens advice and take everything with you x

QQ cannot deny a Standing order. If they get pushy, send them a postal order and pay them £1 a month for the life of the account, or until they adhere to OFT guidelines.

 

Also, do NOT supply bank details or debit/credit card details to them.

Get that DD cancelled asap. They will use ti to debit what they can, whenever they can. They are very well known for doing it. Go to your bank and cancel it, then write to QQ and tell them the DD is now cancelled with immediate effect. Keep a copy of the letter.

They havent done anything in 6 months. I keep a good eye on my account, and they day I see them debit when they shouldnt, is when i cancel it. I only have 56 a month in there anyway. It is prepaid card and only i put exactly 56 in there so they cant debit anything off me even if they tried.

I will get the card cancelled tomorrow as it is to much stress having that account open. Plus Lloyds are charging me £10 for a DD they returned back to QQ.

 

Wage Day Advance and PayDayUK seem to have accepted the £1 token a month offer PaydayUK gave me their bank details without me asking Ive just asked WDA by email to send me there details so I can make a standing order payment.

The Loan Store sent me an email saying they were expecting a payment from me on that Thursday the payment I offered them was £1 so assumed they had accepted the £1 token a month token for the time being but when I explained I was waiting for payment and had trouble at home and promised to get the token payment sent out by standing order tomorrow. There response was they can only accept £20 for 3 months but I need to send an expenditure form in, proof of me not working (like a letter from the JSA) and I think and also want me to send in my last to bank statements as proof that I can only afford £1 a month.

 

Expenditure form with a JSA letter (I covered the private details such as N.I) proof was sent in to Minicredit and Paydayexpress. Minicrud send the occasional text saying my account is overdue and the last email I received from them was saying they need to speak to me about payments. As for PaydayExpress they just ring 6-7 times a day starting from 8am till about an hour ago and send about 4 texts a day which compared to a week ago is nothing so at least the texts are dying out. My mobile is always on silent and I only answer if its someone I know if PDE comes up then I just ignore.

 

Will soon get through this. I heard 50 payday loans companies are under observation and have 12 weeks to clean up their acts hopefully out of those 50 it includes 9 of mine lol!

No. they cant only accept the £20 for 3 months. They accept whatever your financial circumstances allow. Report them to the OFT. They are also not entitled to the I&E form nor the bank statements. The bank statement especially is considered private and confidential info and even the police need you to sign a form or to get a court order if they want to see it. It is up to you if you want to get a JSA letter.

 

Regarding the calls and texts, you must get a full complaint into the lender and the OFT. Do NOT ignore it. Youa re correct that PDL's are under investigation, but NOTHING will be done about them unless you omplain. Don't think others will complain so you dont have to.

Yeah. I was kinda hoping QQ would shut down and wipe off their debts but it not likely lol although i got only a year left to pay and i got it right down to 56 a month.

Ha ive got a call and text blocker for number i dont recognise so my phone rarely goes off ;)

 

Its good that you have managed to sort a lot of it out yourself. Just try and make the payments all to all the people u owe money to, on same date as it will make it easier for you hey x

In the email they sent me they sounding nice whoever it was who sent it. I only explained the exact same thing to Loretta and I got a reply say they are sorry for the situation I am in and the financial hardship and they would try and help me via live chat or by phone. I print Screen sysRQ all over the dialogue and pasted to paint and saved the whole conversation just in case I needed it for future back up.

Loretta seems like the boot camp sort of person out of the QQ collections gang lol!

 

Renegadeimp I will definatley get my OFT complaint tomorrow morning going to work on my complaint now ready for the morning. I actually left apart of this in the last email sent to PDE and minicredit: "Payday lender MCO Capital shut down and fined £500,000 and

Government closes pay-day lender MCO capital | News | The Week"

 

This was after back and forth emails explaining my situation and then eventually sending in a expenditure form and JSA letter proof and after all that... same response your account is overdue and is in arrears ect. So was hoping that little piece of news might of opened up their eyes lol wishful thinking haha!

 

Turkwfye4lyfe after sending back and forth emails with WDA and PDUK and again normal expenditure and JSA letter they said they were worried because my expenditture was going beyond what I could afford after explaining that I am willing to pay £1 a month until I get back on top of things financially and get back working then I would let them know asap. They were both okay with that and PDUK sent me their account details without asking... even though they did send me a text saying my account was in arrears but it was the exact same text they weeks ago. WDA have been quiet since. Got a feeling minicredit and CFO will get in touch tomorrow.

A lot of the bad PDL's are getting their acts together because they know they could be shut down. However there still are a random few PDL's that think they can get away with it.

I sent you inbox hun xx I spoke to Loretta also as i need a statement from QQ and she told me its a 10 pounds charge, to which i told her, i am not requesting a SAR. Ive then emailed a manager who emailed it to me last time ;) oh and i tried to ask on a general level, whats their minimum repayment and she told me she cannot answer for the whole company lol so keep pushing them and they will accept x

I was hoping the investigation would give them something to think about. Just wonder who the 50 Pay day lenders are but I think most of us can guess some of them.

 

I knew minicredit would be hard but they sent like 1 text since that last email including what I said to them reminding them about what happened to MCO. I know I will need help with PDE and probably mini not sure what to expect off CFO yet they said they only accept repayments negotiations after account going over 33 days I think they said.

turkwyfe4lyfe I really really do appreciate that its sounding more positive. Its good to know your all out there to help Ive tried to go it alone but it does get hard just gonna keep strong no matter what.

I know it. I wouldnt have got through some stuff in the past without this site. Ive had help with letters and everything and its all thanks to people like renegade, brigadier, dhx, citizen b and a lot of others.

 

My message to u, was my own personal experience. Try and speak Rachelle next time. she hates me lol but she seems to be most understanding for repayment plans.
