Hi all,

 

I have a complicated situation and I am just seeking some advice if anyone can help.

 

I appologise in advance but I am new to these forums.

 

I succesfully completed a 5 year IVA with Grant Thornton by Oct 2012,

which my main debt was a Natwest Loan which had PPI.In April 2012

 

I started to try and make a claim back for PPI, fully aware that if I had won, any monies could and would be potentially offset aginst any outstanding debt.

 

It took about 5 months to get Natwest to even acknowledge my complaint and this was only done after I complained to the FSA.

 

In December 2012, Natwest Bank admitted liability and I won my claim against mis-sold PPI.

 

They offered £3700, which around £800 was intrest.

I recieved the £800 on December 10th.

 

I spoke to Natwest PPI to find out where the rest of the money had gone.

 

They explained that something was flagged on their system about outstanding debt and the rest of the money had been forwarded to my IVA company.

 

The IVA company then has 28 days to decide whether that money has to go to my creditors or comes to myself. I said thats fine.

 

32 or so days later, I've heard nothing.

 

I ring Grant Thorton.

 

They explain that they never recieved any money from Natwest PPI department (and further more, still hadnt even tried to start closing my IVA!!!).

 

I spoke to Natwest PPI straight away - after much

"can i put you on hold sir",

 

they finally said that they had offset the £2700 or so remaining of my won money against an open account that is in debt with them.

 

I explained that I do not have an open account and have not had so for 5 years as I have been on an IVA.

 

They said they have no record of me being on an IVA.

 

I'm trying to find out now what my options are.

 

I had unbelievable shoddy advice when I was in finacial difficulties orginally from Natwest,

mis-selling the loan,

then the PPI.

 

Now after 5-6 years of emotional stress that they have caused,

they are still causing more.

 

So what can I do now?

 

Any advice would be very welcome.

you need to SAR natwest

 

unless they have sent you a NOSIN [notice of sums in arrears

 

they cant just magic up the rules

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Dx,Many thanks for your reply - I'm trying to educate myself as I'm tired of being pushed around and misled by banks. What would SAR'ing Natwest help me to do? Sorry if I sound naive/stupid.Thanks,Mitchell79

an sar gets everything they hold on you

 

nit picking evidence is a good way to counter them.

 

they cant just off-set out of thin air

 

if they have NEVER EVER sent you an arrears letter

for the account they used to off set

then they CANNOT offset.

 

you p'haps need to SAR GT too.

 

something has gone wrong their way as well obviously.

Hi Mitchell79,

I have a relative in a very similar position as yours.

May I suggest you speak to Grant Thornton and ask them to supply you with a list of who they have been distributing your funds to over the term of the IVA? Have you not been receiving annual statements from them?

Grant Thornton have advised my relative that ALL PPI minies are to go to the IVA and only the interest is allowed to be refunded to their clients under new rules apparently. Have you not received details of the new rules?

 

Stay firm and strong with both these organisations and make sure they close your IVA on time and that you have the relevant certificate of closure.
