Hi all

I am asking for help on behalf of my Auntie and Uncle

 

They had a Mercedes on lease hire and was returned, at the end of the lease.

They had the car valeted and any defects taken care of.

 

Mercedes have now sent them an invoice for £800.00 because the last service was not carried out by one of there dealers.

To me this is extortionate, is there anything that they can do, to fight this, I think it will end up in court!

You will need to refer to the terms of the lease to establish entitlement if any. In the meantime I would suggest that you write to the dealer and request prcise detail of how the figure demanded was calculated.

Hi All

 

Apparently it was in the contract, that it should be a main dealer.

 

So I suppose the only thing that can be disputed is the amount they are trying to charge.

So the best bet is to get them to justify the £800.00?

I have passed on what you have advised,

 

What they are saying is that because the service history does not show the main dealer stamp,

that they can not sell it on from one of there dealerships, so I guess that is where they are saying the loss comes from.

Can you post up the terms of the contract referring to the aboveplease; because if the wording in the contract as to service of the vehicle states“should be a main dealer” as opposed to “must be a main dealer”, then it mightbe the case that your aunt and uncle are not under any obligation to perform anact that the dealer “would like them to perform”, therefore, no breach ofcontract = no liability to pay the £800. (this is only a suggestion as of thedate hereof, worth having a read of the said contract term to establish theforegoing)

Just had a quick chat with my uncle, he has told me the wording

Unfortunately he is in Northamptonshire and I am in Essex

 

The main part staes

The vehicle must be service and maintained in accordance with Mercedes Benz

 

I hope that makes sence

The way I see it it does not state must be a main dealer but must be done in accordance with Mercedes service manual

Don't wish to confuse the matter, but the above is not unequivocal.

 

Before your aunt and uncle pay £800 to merc, can you please type up word for word the relevant terms of the contract as to this service requirement on the vehicle.

I have spoken to them, and they are going to email me a scan of the contract,

As soon as I have the copy I will post it up
