Hi All,

 

I have recently got a letter from Barclays telling me about a loan which was taken out in 2005, although the loan has since been settled. It did state that I took out PPI at the time, and encouraged me to make a claim. The thing is that the original loan was for around £5,700 or so over 2 years and its now settled according to my credit file.

 

I cant find the paperwork for the loan etc. I am here asking for help on where to start with claiming my money back.

I am assuming that when B/shark wrote to you, they would have given you an account number. You can either trust B/shark to calculate a fair refund or you can send a Subject Access Request and ask for all the data they have in respect of your financial dealings with them - they have 40 calendar days to provide this. You should send £10.00 with your request (the statutory fee) You will be looking for statements, perhaps a copy of the original loan paperwork.

 

You can then complete one of the Spreadsheets from CAG, enclose the form from the FOS website then submit your claim.

You are right, there is the account letter at the top fo the letter. I want a quick resolution to this and quick payment, If i go with the approach of them calculating how much is due back. What should I do ?

I have the fos questionairre, also I noticed that one can fill in the questionairre online as well from the barclays website, however its asking me for the details of the loan etc. I know the exact amount borrowed by looking at my credit file, but thats all I know at this point in time. I do not know anything else. Should I fill in the barclays form online and submit it or just go all the way and SAR them ?

Hello everyone

 

I recently got a response from barclays about the PPI claim, they have asked me to send information about my health condition, proof of employment and other documentary evidence. I'm in the process of compiling the documents and was wondering if anyone had any experience with a situation like this.

 

I was thinking the claim would be approved without any request to see dociments etc

If you have mentioned that at the time of taking out the loan, you had serious health issues that would have invalidated any claim that you might have made, then they will likely ask you for proof of this. I am not quite sure why they would be asking for proof of employment though.. so I will ask one of the PPI guys to look in on you :)

imho you need to SAR Barclays

 

yo tneed the info THEY HAVE

 

to decide if their redress is correct anyhow.

 

I would not trust BC as far as i could kick them.

 

they certainly have NO RIGHT

to see any of that info

without VERY good reason

 

I have never know any creditor on a PPI refund to ask for such.

 

can you scan up what you have sen them [FOSCQ etc]

 

and this letter please

 

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all monetary figures and dates.

convert existing PC files to PDF [office has an installable print to PDF option]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice dd-mm-yyyy TSB

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Sorry, I cant see where they are asking you for proof of employment / health issues

 

What they have said is that they are not prepared to uphold your claim as they say you visited the branch to take out the loan - that a Statement of Needs and Demands was under taken and that you agreed to the PPI.

 

Is this correct ?

 

If the information on the Statement of Needs and Demands is incorrect or has been misrepresented then you will of course need to supply proof that you had been in poor health or had health issues in the previous 2 years before taking the loan. Did you agree to the PPI and was it due to any pressure recommending from the Sales staff. Or is that that SODN so much rubbish.. does it have your signature attached to it ?

The statement doesnt have my signature as part of it, I really cant remember what was/wasnt said to them, but the diabetes condition has been long standing. I seem to recall that during the meeting, it was made as if, should I not take the PPI the loan would be declined, it was alsmost sold like a compulsory package.

 

The issue now is that since they have declined to uphold the case, it would have to go to FOS, or is it worthwhile writing them one final letter ?

I finally got a response to my SAR from barclays. I have looked through all the documents sent, and now I have attached the document which is the CCA for the loan.

Thanks for your reply, now that barclays are telling me to go to fos, I have got the documents from the SAR request, what documents do I need to send to support my case. Already I have a pre-existing medical condition which automatically excludes me, I have a letter from GP stating the treatment start date (way before loan was taken out)

 

Also with the single premium route, should I just state this in the form that I want to send to FOS. I'm thinking of what documents I can send to FOS so as to speed up the process, especially as I have all SAR documents with me.

I will ask the PPI guys to look in on you.

 

Sadly there will be no way you can "speed" up the FOS - they will take their own sweet time :(

Can we just refresh where we are at please?

 

1 -> Did you send a completed fos questionnaire to the lender as part of your claim?

 

2->Have you done the spreadsheet calculations that dx pointed you to above? If not, this is the spreadsheet you should use which will help you work out what you should be getting back.

If it were me I would challenge the lender first rather than go to fos straight away. As has been said, you have six months from their decision to file the complaint with fos.

 

It seems you have a demands and needs statement which has not been signed by you and there is no way of telling whether this is accurate. Remember, never trust a bank. You also have a pre-existing medical condition which would have excluded you from the insurance. These points will form a good basis for the challenge together with your assertion that you were told you must have the PPI. Does your medical condition feature on the Demands and Needs Statement?

I filled the FOS questionarrie and sent to barclays, stated health conditions and also the fact that I was told it had to be taken as part of loan, I had employment benefits etc.

 

Yet barclays declined to pay out and upheld their decision, so it looks like I can either go back to them in light of the SAR revelations or go straight to FOS.
