Sorry guys and girls thought I had a bad mark against me for something I had written.I have now had letters from the court saying that both GMAC and Halifax intend to defend in full.Now I have had this four times before with the Halifax so do I take it that its just proceedure or are they putting things on hold since the oft case,or are they still paying out later.Regards Nigel

A lot can depend on your local court. As a lot are still continuing claims as normal.

Well Leeds seem to be proceeding as normal,I've had an acknowledgment of receipt and with intend to defend in full,so wait and see eh.thanks you guys.I'll update any news I have on my progress.

hi nigel now you just sit and wait to see if you recieve a AQ some courts do and some dont but they will be in touch

Hi Nigel,

Just because you have recieved defence does not mean Court has, Keep checking with court as sometimes they miss, see deadlykiss`s thread. if they have not filed with court at en of 28 days after deemed served date, you can go straight on and file for judgment. If on the other hand they have filed, then court will advise you of next step.

Ok,thanks you guys.my last three cases were solved straight away as they came to £9.5k.so we'll see what happens here.

one interesting thing I've noticed with the Halifax they have recently kindly repayed my most recent £39 dd failure's when I have contacted them.Apparently they only do one run a day on dd's so your money has to be in the day before to catch the next days dd's.no one told me that,some dd's go out during the early hours so even if you put money in the next morning you've probably missed the dd payment.BE WARNED EVERYONE.

Yeah that`s right Nigel, also other way with money going into your account go in at end of day. they are also refusing to accept cash over the counter, you must use envelope and post it into cash machine. This give no record that you have paid cash in, is wide open to dishonesty by staff, all you have is tab that you remove from envelope. They will tell you that they do not accept this as proof of cash being paid in. what possible reason can they have for NOT accepting cash! They are a bloody bank after all. this is another reason why I took my account elsewhere.

Hi everyone.Just received letter from the courts, the district judge has stayed the action pending the case between the oft and nat west.

 

whats this bit mean

 

"If no party shall file at the court office by 4:00pm on the 4th March 2008 a written request for directions and/or a hearing date the claim shall be struck out without further order on that date"

 

This order was made of the disrtrict judge's own initiative.If you object to the order you must make an application to have it set aside or varied within seven days of receiving it.

 

So mow looks like Leeds are staying their actions.

Can any body tell me what I can expect from Halifax as we are due in County Court.

 

Halifax has refused to supply a copies of my statement and are using the manual input as the defence of mot supplying the statement that was requested December 2006.

Hi again everyone,when you ask for thye stay lifting what does this affectively do.? Are you basically for a judgement and a hearing or if the stay was lifted would the bank give in before the OFT case was heared.

If they lift the stay, then you can proceed with your claim through the courts.

Tere have been plenty of stays lifted and cases are still being won.

MMMM that looks complicated.Following on from this,are they saying that we have to do all the points and copy them or do we just do the n244 form and have the rest and copies to hand in case we do go to court or do we send the lot in with the n244 form.gees regards nigel
