      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am a customer of brighthouse and I know I should not waste my money but today went to buy a PC and I was disgusted with what they have done they have made all the extras compulsory and the apr thing is now 69.7%. the manager who I know said yeah we have put all the stuff in the cash price so you have to pay for it even if not needed from last week the cash price had gone up by about £400. Sorry tough take it or leave it. This is wrong people need to know they what they have done before you get lured into debt and to get around the comments by making it more expensive then add massive interest I want to email my mp should I contact any other people as this is so wrong

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Just remember, nobody NEEDS anything from brighthouse. You can get cheap and decent stuff from charity shops or even freecycle if you are in a tight spot.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If they have indeed done this, then it might be possible to challenge it as an unfair term.

 

If anyone has a copy of the terms and conditions for a product that now has this high APR, can they please let us have a copy.

This is indeed correct.

 

I spoke to them today and asked what it all meant.

 

I was told that there are no such products now called OSC and DLC,

all they have is this Single Price Agreement, take it or leave it.

 

I pointed out that the cost per item had risen which I thought was underhand and unfair.

 

For example I have 2 items which total 5.30 per week excluding OSC and DLC from prior to 02/09/2013,

the cost of these same items post 02/09/2013 under the new Single Price Agreement is now 8.00 per week

and that's if you have a decent credit rating with them so it could be higher.

 

Also the manager told me that that figure was based on their lowest APR or 69. something but the website claims that the lowest APR figure is 64. something.

It has been noticed that the BrightHouse reps have not been overly active despite the company's request to join CAG. The requirements were that they would be active in helping to resolve the issues raised by their customers and to provide updates on the threads to which they responded. To date I don't see much which would show that they are living up to expectations.

 

There is little point in having company reps on CAG if all they want to do is provide a customer service contact and hope that is the end of it. Reps on CAG should be actively posting to try and resolve issues and are given the chance to improve the reputation of their company.

 

As a result the account status of BrightHouse is being reviewed which may lead to their accounts being deactivated.

 

As a footnote, if anyone reading this thread has a copy of the new BrightHouse terms & conditions whereby the OSC and DLC is automatically included but with a huge rise in the APR, can you please PM me and I will give you an e-mail address to which you can send copies of the documents.

It doesn't refer to OSC and DLC in the Ts and Cs,

the manager said they didn't exist anymore,

but what it does say on the website is that the rep APR is 64.7%

but when I rang he offered me 69.9%.

 

I asked him how come it was so high as I thought I had a very good payment record with them, 2yrs 3mths customer, large account and no missed payments.

 

He said I had a very good record with them and 69.9% was their lowest, but the website says 64.7%!!

The website also says included in the (blatantly inflated )cash price (and APR figures) the single payment gave the customer unlimited repairs,

like for like replacement, 'cover' for accidental damage, fire and theft.

 

I told him, as he already knew, that I had a very good home insurance policy that 'covered' my goods for all of the above

so I shouldn't be charged the same as someone who doesn't and who may need to claim from them,

I will never need to because of my own policy with my insurance company.

 

He said that's the way it is, one single payment like it or lump it!!

 

How can they be allowed to get away with what can only be described as daylight robbery?

 

I gave him a direct example of the goods I had now, what I was paying and how much the price had risen on the same goods,

which I only bought in July by the way.

 

He said again that's the way it is!!

 

I know people say we shouldn't shop at these types of stores but why shouldn't we?

 

The question should be how on earth can they get away with it?

No reason why you shouldn't if you are prepared to put up with all the grief that comes with dealing with this type of company.

 

As a cost effective alternative, people could do far better by investigating their local credit unions. That way they could borrow money at a far far cheaper rate and buy the goods that they want at decent, uninflated prices. Yes you may have to pay something in to a credit union before you are eligible to borrow but my view is that this is far better than dealing with the likes of Perfect Home, BrightHouse, Buy As You View and the like.

You are absolutely right and I do now have a credit union account. The problem was that I had to leave my home and move elsewhere very quickly at the time, with little more than what we stood up in so they reeled me in and, to be fair, I have had no problems at all with the staff or their products. I just didn't have much of a choice at the time. Now I do though but feel very sorry for people who maybe find themselves in a similar situation to what I was and have nowhere else to turn.
