Hi all, I am just about to send a failure to comply letter following a CCA request and was planning to include the "no doorstep visits" letter when I came across this on debtquestions.co.uk:

 

"It is acceptable for debt collectors to visit debtor’s homes if the debtor has agreed or requested a visit; debts are disputed or deadlocked, or the debtor has avoided contact. However, debtors must be forewarned of a visit and given time to seek advice or support before the visit. If a debt collector comes to your door and you request him/her to leave, they must do so."

 

Does this mean then, that if I put the debt in dispute, the DCA could send someone? :???:

Your reading into this far too much.

 

If someone turned up at your door asking you if you had a washing machine and could they come in and look at it, you'd quite rightly and lawfully tell them to take a hike!

 

DCA's have NO LEGAL POWERS, they have NO LEGAL AUTHORITY to turn up at a someones house demanding money, they should be treated exactly the same as someone selling wooden pegs.

ALL of their letters are nothing more than psychological harassment, littered with lies, falsehoods and should be laughed at, they are spectacularly immature and incompetent.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Seriously you have absolutely nothing to be worried about where DCA's are concerned, they are for all intents and purposes they are as much use as indicators on a submarine.

Also when the person does leave, they will rant on about going to Court this, CCJ that etc.

 

This is only because they are self-employed and have used fuel and time to visit you and got nothing for it - oh dear, how sad!

 

Let them rant, don't forget to film on your mobile phone, edit the footage and place on youtube.

If they turn up, ask them if they would like a cup of coffee, if the answer is yes direct them to the nearest well known coffee house chain and tell them to chase up the outstanding tax bill - this is a much bigger issue than personal debt.

Hi Guys, just thought i'd update you following my posts above. After receiving the letter from ScotCall regarding DoorStep visits i sent a letter requesting CCA along with a postal order for £1 as recomended. Well today a received another letter from ScotCall along with my Postal Order explaining that they are no longer dealing with this debt. Thanks for all the advice, i wouldn't of got by without everyones help.....thanks :)

Well today a received another letter from ScotCall along with my Postal Order explaining that they are no longer dealing with this debt.

 

If Scotcall do not own the debt, all they have done is sent it back to the Original Creditor, so expect to hear from more pondlife within days/weeks/months.

Result for now - suspect you might be on the DCA merry-go-round. Might be a good idea to CCA the OC to see what comes back or wait for the next DCA and then fire it off - I would tend to go for the second option and wait to see which scm-bag outfit surfaces.

 

In the mean time - chill.

Hi simmsy - have they said who would now be dealing with the debt? Or have they closed the account/cancelled the debt (or whatever they do)?

It just said 'Please find enclosed Postal Order for account that we are no longer dealing with, please contact the client direct quoteing ref number ********'

The client is Santander who i am bout to send a CCA request to aswell

im having a problem with scotcall at the moment, so what did you actually do to get rid of them as ive had phone calls from them but never answered and then a letter came through saying they would past it onto a field agent

If you could please start your own thread because although you are having similar problems with Scotcall, all debts are different.

 

If Scotcall telephone you and you do answer, refuse to go through the security questions, refuse to confirm your name and just say "in writing only" and hang up.

If anyone does turn up at your door, simply tell them to get off of your property, if they refuse, call the Police who will remove them for you.

 

Send Scotcall the telephone harassment letter and also the doorstep letter, these are in the Library section, top tollbar in green.

If a Field Agent turns up, also hand them a copy of the doorstep letter and shut the door.

They moan with threats but they are self-employed and you have made sure that they are out of pocket.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
