How much before a CCJ?

Just wondering if their is any general limit to a debt before the creditor finds it worthy enough to issue a CCJ.

 

I am now 26 but about 4-5 years ago i had mobile phones that went into default with differnt companys etc etc.

 

I checked my online credit report with equifax a couple of days ago and it says my overall debt with everyone is £1837 and my highest debt to one creditor is £499.

 

Seen as i have moved around living differnt palces for years its never really caught up with me and my credit report shows i have no CCJ's.

 

At 26 and starting to settle down now, i would prefer to keep with no CCJ's.

 

So was wondering if my kind of debt is not worth their time when creditors have people owing £10,000 + on one credit card,

and also if there is a time limit where they just wont bother pursueing it anymore.

Hi Bongo and welcome to CAG.

 

Once a debt reaches 6 years age (5 In Scotland) with no acknowledgment from you or payment the debt becomes Statute Barred.This means the creditor is unable to force the contract re litigation.However the debt remains and you may be approached to make payment ..any default will remain on your CRA file for 6 years.

Hi there.

 

In addition to Andy's kind words I've seen CCJs get award against people for as little as £50 - although that is very uncommon. If you live in Scotland, once the 5 years is up the debt is extinguished, which means it no longer exists. In England/Wales it still exists, it's just that you'll be able to defend court action. In short, if you've been living 'under the radar' it doesn't seem like you've too long to go!

i would continue to keep your head down.

 

very very few mobile phone 'debts'

are actually the value they claim

and very very few ever bother to do anything about them.

 

when you did your cra file

did you update your address?

 

if so

i'm sure a few leeches will now write you!

 

just remember

 

NO dCA has any legal powers,

so DON'T fall for the threat-o-grams.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
