Good letter. This should go to whoever is in charge at Northampton and with a copy to Ken Clark Secretary of State for Justice, as he may be interested in the potential loss of revenues.

Just to let people know I have posted the letter by recorded delivery today. Will post a response when I get one!

 

I hope Robinson Way have started applying to substitute the claimant to hoist.... this is going to cost quite a few million in the long run !

Yes I think that they are in breach of this, but how would anyone report this. i.e who is mandated to take action OFT. Perhaps make enquiries through Trading Standards.

Don't worry Uncle B I know the correct people it will be first and foremost the specialist complaints section in what was the DTI which is now BIS I will also cc OFT Im just not that knowledgeable about tax or insolvency law and wondered if it could be a further wrong thing that RW have done.

My only slight doubt is about the timing of what RW did. They did this pre pack arrangement within a short space of time and I suspect that it may get around this particular law.

 

The point is that this law was written to avoid confusion about the company that is trading.

 

Worth reporting, but I doubt you will get any clear response.

I am obviously going to send a witness statement to the court and the claimant in relation to their application to substitute the claimant.

 

Does anyone know how many days before the hearing I have, to file and/or serve the statement with the claimant and courts ?

It was a bit of a joke the judge was a joke. He didnt grant them the substitution but asked them to respond to my latest statement. It was almost like the judge was representing the claimants dismissing my arguments. The thing is I had a very heavy flu, and its a lit bit of a blur I will post more details later. Im also moving and need to get the court changed.

What Order has the DJ issued? Sorry I was under the impression that this had got to the Trial stage.

 

No where near trial stage. The judges order was so long winded and convoluted that I cant remember it as I was dying with the flu at the time. The minute the order comes through I will scan it on.

 

I am moving to London so I have asked the court to transfer to my local court at my new address. Hopefully this wont cause a problem.

 

I will post my witness statement in response to their application to substitute. The judge said something in the order about responding in full to my witness statement. It is a joke and a mess !
