Charging order

Hello; Is anybody knows if Welcome finance can apply for a Charging order on the house. I've taken unsecured loan from them.

They would have to get a CCJ on you 1st before then can apply for one.

But if they are bankrupt can they get ccj?

I went bankrupt, if you have named the creditor in the bankruptcy listing when you applied for bankruptcy, and you havent been able to pay your creditors becase of no funds available then no you wont, when you go bankrupt an assesor from the DTI checks all you finances and assest and determines if you can pay somethiing to your creditor in my case i didnt have anything, what the assesor is looking for is stuff they can sell, basically gold jewellery cars private number plates..........not clothes toys or furniture or computers as there is no money in them, the assessor is very good actually you would be surprised at how much you are allowed to live on for instance.............its very very fair...........hope this helps

If you are bankrupted then all your debts are put together including the CCJ's......you won't be able to get any further credit whilst bankrupt so it may be difficult to get a CCJ whilst bankrupt (but it depends on what the debt is for)
