Hi

 

I received a refund from barclaycard of £312 on 31st August 2007, for overlimit/late payment charges.

 

I had written to them again recently to get a refund of charges since then, and this time i got turned down. They said that the £12 charges comply with relevant legislation and guidance, and this is a final response to my complaint.

 

Whilst i can understand them saying the £12 charges comply with relevant legislation, this was also the case the last time, yet they did refund the charges then.

 

I'm a bit confused by this and not sure what my next move, if any, should be? :|

 

Any advice anyone?

The charges don't comply in the sense that they would have you believe.

£12 was identified by the OFT as being the limit beyond which a charge wouild automatically be considered unfair. However, the OFT made it clear that charges any less than £12 coiuld aslo be unfair - only that the OFT would seek to take any action in those cases.

The OFT rather copped out of thier responsibility - even though they then went on to announce it as a victory. It wasn't. It was a poor compromise.

We have had people claiming back their £12 from B'Card - if you stick to your guns and are prepared to take action.

Face it, Barclays are crooks - they have proved that many times recently. Why should you believe them about anything.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Have a read of some of the BC **WON with compound interest** threads here - http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?97-Barclays-BCard-and-Woolwich-successes

 

Read as many threads as you need to get a feel for how others have successfully reclaimed the charges with compound interest in restitution on top. Make notes of what you think make assist in your own case.

 

BC will refuse to take any reclaim that includes restitutionary interest seriously until you file a court claim again Barclays Bank PLC. Then they'll take note and usually repay before any court hearing.

 

Do the reading and then come back with any questions.
