I had a hire purchase agreement with RCI (Renault).

 

I missed various payments and eventually defaulted on the account.

 

Since then I have almost paid the account up and owe them about £200 still which I have agreed to pay them next month.

 

Although on top of that im claiming back PPI and charges (£40 a letter!),

but thats not what im here to talk about.

My question is are RCi in the wrong with thier default on my credit file, in terms of date...

 

I think the ICO says that default should be noted on an account within 6 months, this is the comment from here:

"Accounts should normally be filed as being in default where those

payments due have not been received for six months."

 

looking at my credit file below they should infact have registered the default in at very least oct 2007 (meaning the default would drop off my credit file next year) but infact they kept it going for over a year and a half before registering it.

 

 

 

What are my options here in terms of getting the default put to the correct date, and is my interpretation of the ICO document correct?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

or

convert existing PC files to PDF [office has an installable print to PDF option]

ENSURE: remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

or if you have PDF as an installed printer drive use that

or use word and save as pdf

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

... so what was the outcome because I am in a similar position???

 

Me too, I'm in the same position with a 3 year error in default date.

 

I've come to the end of assistance from equifax and experian, to whom the company lied to and advised they have sent me 2 letters after my initial CCA request, when I only relieved 1. It's been more than 5 weeks since I sent my original request.

 

I'm frustrated at how the credit agencies, especially data controllers can add default notices without proof and then do nothing about it when challenger by the consumer.

 

I think all you can to is send a SAR (subject access request) to the original creditor and the DCA (debt collection).

 

At the same time, contact the ICO and also the financial ombudsman to enquire in what they can do.

 

I should have a clear credit file now, but this company took over the account and changed the default date and now refuses to accept the file should have been removed a long time ago.

i had a look today at my latest credit file, and the RCI part of the file is gone, the whole agreement is gone.

Very strange.

 

All i done was send them a letter regarding PPI charges and tagged a part on at the end regarding the credit file default notice being wrong.

 

They then replied about the PPI but never mentioned anything about the default notice,

ive been so busy I hadnt looked at it recently till today,

and to my surprise it had disappeared.

 

.. im not complaining!
