I received a letter from Arden regarding an unpaid loan from Lombard.

 

In the letter Arden state that there is a CCJ against me,

but I have checked my credit report which is right up to date and no CCJ appears on the credit file.

If this is the case aren't Arden acting illegally by giving out false information.

 

Advice please.

Last payment was roughly 3 years ago. This is a strange one ... After taking out the loan I was able to keep up the payments for a couple of years then due to ill health I was forced to stop working. I wrote to Lombard several times but never received any reply (all letters sent recorded delivery). Arden contacted me about 3 years ago and I made a few monthly payments but stopped paying as I couldn't afford the payments. I hadn't heard anything from Arden (or anyone else) until now and I never received any notification of a CCJ .. I'm confused!

as advised check www.trustonline.org.uk

 

if nowt show there

 

[just remember if you have moved in the last 6yrs

you must ensure you use THAT address is used

and shows as linked on your CRA report]

 

if it proves that no CCJ shows...

 

you REALLY need to complain to OFT/ICO etc MP et ALL

 

about ardens letter.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

A bit of extra advice. If you want to send either a SAR or a CCA Request, then don't send it to Arden. They will simply return it and advise you to send again to their (now) parent company - Idem Servicing.

 

Arden should have written to you, notifying you that Idem are now the "controllers" (or similar wording) of the account. Just thought that might save you the time/hassle/postage.
