Hi Folks,

 

I'm currently in battle with the Clydesdale and they're really not playing ball in providing me with all my previous 6 years Transactions.

 

I sent off the Library Letter to request my transactions, was then told that there would be a £5 per statement charge for this.

 

I advised them that I wasn't paying this, and under the terms of DPA it should only carry a maximum £10 admin charge. I was then told what I needed to to was fill in a DPA Request Form, which I've done & sent off, but this morning I've received ANOTHER letter from them telling me:

"As per the Data Protection Request Act, and in reference to your original request, if it is purely copy statements that you require then this is not covered under the act, as these are documents that have been issued to you previously.

 

If you do require copy statements we can arrange this for you at a cost of £5.00/statement.

 

If you wish to contact the branch on any of the above points please call directly on 0313 456 4501."

I'm just going round in circles now, a good 3 weeks since I sent in the 1st letter.

 

Can anyone give me a nudge in the right direction please.?

They are correct that statements are not covered by the DPA. This is the problem when you let them sidetrack you. Check the wording of the DPA letter in the library. What you require is a complete list of transactions and charges - alternatively, a set of statements will do but that is not what you are requesting.

 

I would advise that you send the DPA request again, along with the £10 fee. Once they have the fee any debate can take place - but the clock has started. At the moment you are no nearer getting the information than you were when you started.

Thanks - My previous experience with this company had already prepared me for how useless/obstructive they can be.

 

I'm going to send off another letter tonight, highlighting your points above that I didn't request statements, I reqested transactions - although statements would be accepted as an alternative.

 

I cannot stress how badly I want to get my cash back off this bunch - I feel nothing but contempt towards them!

 

Thanks again for the pointers - I can't help but feel a bit out of my league with all this, but I'm damned if I'm being put off this easily!

How are you getting on with this? Have you got a list of charges yet? I also hate their guts and got the '£5 per statement' response.

Virgin/MBNA £435

Mint £20

Morgan Stanley £120

Clydesdale Bank £299 (pending;court case started)

HI Guys

I am also in the queue for this.

Have sent off the letter and my £10 awaiting reply.

I suspect they will close my account so have opened an account with the allince and leicester with 0% interest on overdrafts for the first 12 months.

Have looked back my statements and been charged £284 in the last twelve months purely on interest and their £7.50 gold account fee.
