Hi again Dx and and crem.

Thanks for your comments on my previous posts. I have now recieved the SAR request for my second Car with BCT. I am still in possesion of the car in question BCT are threatening to take the car and have now passed the debt onto wright recoveriesn but have yet to persue through the courts.

My issue with them is that I am not sure how much I owe them if anything at all. They have sent me a retrospective statement from which I am finding it difficult to understsnd how much I have actually paid and what is still oustanding.

They have listed over £300.00 in defaults and interest charges and added 250.00 for GAP insurance when I requested not to have GAP insurance. It would be great for some advice on this and could PM you with the hard copy of statement.

It would be nice to formualte a letter of a full and final but not sure hoe much I owe so your help is gratly appreciated.

Cheers Tomtom

Many thanks

okay I have done that and attached it. Its £330.22 witout interest and £484.21 at 28% APR

I have no information/documentation in the SAR regarding the GAP insurance, including the interest, other than I know that they have charged me for it (£195.00 as first payment) even though I did not request or sign for it. Infact, I recall decling GAP along with PPI when they asked if required it.

thanks again Dx

I'll upload an uncropped version of the HP agreement but there is nothing eluding to GAP insurance other than what you can already see. I'm pretty sure they should not add interest to the one off GAP payment but how do you work out if they have.

The HP agreement is only 2 pages long. I have put 28 APR into the xls sheet.

there are several glaring things about the agreement and the statement list

they have charged for a 'document fee' on the statement however that obv equates to the 'arrangement fee' on the agreement

add the doc fee to a copy of the statint xls please, it is not specifically listed in the sign agreement so get it back.

add the GAP ins to that statint sheet too.

it is mentioned in the agreement [as such] but has not int added, but you have not signed for it.

Okay Dx done that and attached the file, the sum is getting bigger circa £2700.

So with this what do you suggest my next move to be. Can they not charge interest on the arrangement fee?

Cheers

Hi Dx,

So the amount they say I still owe BCT £1268.43.

However, they have charged me £484.21 in charges and interest of whci includes 28% APR.

They have also applied a document fee (£480.00) and GAP insurance (195.00) which when interest at 8% APR is added equals £909.78.

Therefore (909.78 + 484.21) - 1268.43 = £125.56. This is what thet actually owe me.

I am not actually interested in extracting money from BCT but a nudge in the right direction on how to approach BCT with a letter would be greatly appreciated.

It would be nice for them to accept this view but my guess is that they will chase the oustanding amount using Wright Recoveries.

Cheers
