Does any one know if there is a monthy limit that the council can expect me to pay off my council tax debt.

My council say the minimum is £15 a month which I will find impossible.

I thought that f I could only afford a £1 a month then they had to accept that.

I think as this is a TAX debt not a credit debt things may be different.

Others will know more.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Overpayments of Council Tax Benefit are not the same as actual Council Tax arrears (at least they were not last time I looked) they are not recovered by the same procedure ie the Liability Order route.

 

They are basically a non-priority debt unless you have an ongoing entitlement to Council Tax Benefit then the Local Authority (council) will usually recover monies from this direct, meaning you would have to make up the difference on your actual council tax bill or you would technically then start to accrue Council Tax arrears.

 

If you have an ongoing entitlement to Council tax benefit and there is a deduction in place for an overpayment you may be able to negotiate a lower amount if you are struggling.

 

You can receive varying percentage amounts / awards of council tax benefit - full or part

 

You need to check if this an overpayment of benefit and not actual council tax arrears, if so you should be able to negotiate / make an offer of payment like any other non-priority debt - the council will be open to other forms of recovery action and it has been known for accounts to be passed on collection agencies who also operate as bailiffs if you get the drift. - you know they might sort of think that you think overpayments are the same as actual council tax arrears, of course it would all be just a misunderstanding

2.107 If the claimant, their appointee or agent, or person to whom benefit was paid, could not

reasonably have been expected to realise this, the overpayment is not recoverable.

HB Reg 100 & (SPC) 81; CTB Reg 83 & (SPC) 68

Note: The question of whether an overpayment is recoverable is separate from the question of

whether to recover it.

Quite a lot in there, and when you think about it, all that just for council tax & housing benefit, no wonder people are struggling.

 

I found a few interesting sections myself to be honest, you never stop learning in this game, thats a fact
