      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

One thing though, Ims, is that I'm not sure if I should have made a copy of the questionnaire, spreadsheets and covering letter I sent off to the bank originally, as it turns out my original files have been damaged or were never saved. Can I ask the bank for a copy of the PPI claim info I sent or does it actually matter now?

 

If you are happy with the amount offered then you don't need the papers although it is always a good discipline to keep copies for future reference

 

Also, I don't really want to hold onto all the old data on printed sheets that the HFC bank sent me so I could make the claim in the first place. Should I wait until all my debts with HFC are paid off before disposing of them (by fire, preferably)?

 

If it were me I'd hang on to them because if you have cause to SAR them again you may not end up with the stuff you have now.

When the PPI claim offer letter came, I signed the right forms and sent them back as soon as I could, but how will I know that they've reduced the amount? I only get a statement from them once a year!

 

I asked them to reduce the debt as much as possible, and I also asked them to reduce the monthly payments to something like £16-17 instead of £30 - but can a Direct Debit be altered, or will there be a new one set up and I have to remove the old one?

 

Put basically, will I get a letter stating the new repayment schedule, complete with updated statement, or is it up to me to call them?

 

I don't even know if the signed forms were returned to them, I never sent it Recorded Delivery or anything. I'm sure I wrote down the return address correctly, though.

 

And would it really take up to 28 days to process, as they claim?

Well, I checked my DDs on my Barclays online banking, and it says it's still £30 per month.

 

Is there a (preferably) free number I can contact HFC Bank on to find out my balance, or even order a statement?

I contacted the number on the site, they gave me a PPI number to call instead, and that lot told me that it would take 28 days as stated, including an extra 5 for something else, but that it would be taken off the account (but only about £860, I thought it was going to be £1200 judging by the forms I filled in).

 

They assure me the payments will be reduced to £15-16, but I don't see how any bank can alter an existing Direct Debit...?

I've just received a settlement statement in the mail, meaning I have to pay back £1830 by the 6th September this year.

 

But I never ASKED for a settlement statement, only an ordinary balance statement.

 

What do I do now? Just ignore this statement and continue the repayments as always, or do I have to contact HFC Bank again?

It's OK, IMS, I called them and they said it was just a statement, not a request for payment. I can ignore it if I want.

 

In any case, a repayment for the loan was taken out of my bank account last night, and it was the PPI readjusted repayment of £15-16 rather than £30. So that means that the PPI has indeed been successful.

 

What's more, my annual statement is due soon, and I requested it once the PPI claim was "applied", so I'll know for sure what my readjusted loan repayments will be.

Well, I'll let you know when the statement comes, what the new remaining loan amount will be, I'm not quite sure what it will be - I said it could be down to around £600 left, but I've been told it may be more like just under £1000.

Ims21, the statement came yesterday, and the amount I owe has been revised from £1830 to just £906 !

 

The monthly repayment reduction is also on there, and so I think you can consider this a successful PPI claim.
