      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am currently trying to sort out my PDLs.

 

Payday Express is one of these and I can see they're a bit of a nightmare. However, I took a loan with them in July of last year and it has been rolling over ever since. The amount is £500 which means I pay £100 per month in interest. I have not instructed them to only take the interest, and by my count they have had £800 out of me and I still owe £500. My questions are this...

 

1. Should I have a new loan agreement with each deferral?

2. I am going to write to complain to OFt and FOS, However am also going to complain to the company directly. How do I go about doing this, and what should I say?

£100 a month? Somethings not quite right there. You say you have paid £800 and theyve said its interest only payments. How much does the total debt stand at?

Youve paid more than you owe. In my opinion you should write to them stating that you have now paid the amount owed in full and the interest payments are unfair and extortionate. make sure the letter/email states that it is a FINAL settlement and any communication bar a letter confirming the debt fulfilled will be classed as harassment.

 

Thats just my opinion though, and i'd prefer someone else to come in and state a few regulations you can use too.

Some regulations would be great if anyone else can help with that, and possibly a template letter! I should imagine I will have a bit of a fight on my hands, however it is extortion (especially seeing as I haven't got a copy of CA despite THEM rolling over the payment everymonth with no authorisation from myself). I have changed my banks details now so they can't take anything anyway.

Well, the first thing you should do is ask them for a breakdown of the debt and a full and detailed explanation on how they come to £100 / 20% interest per month on a £500 loan.

You wil be hard pushed to get them to accept roll over fees as paid balance

could be wrong with the OFT looming over them so it may be "gestures of good wil"!

they will say you could have paid bal off in full or set up a re-payment plan before now

the onuis will be on you to prove you didn't know this

the many people that have been in this position are testimony to this and there isn't much by way of success in this

I'm not trying to be a chancer, or wiggle my way out of anything, I do want to set up a repayment plan, but I just want to make a complaint about how they go about rolling over loans without taking instructions and stating that they do. That's all!

For what it's worth i borrowed £400, rolled it over for 12 months paying £100 per month in 'interest' every month. Then thought i am never going to pay this off so after numerous emails letters etc trying to negotiate to no avail. I said o.k enough is enough you want the money take me to court..knowing i had paid it back 3 times over.. not heard a thing for 6 months. Stand up to these people do not answer phone calls etc they soon move onto someone else
