Do SAAS overpayments qualify as statute barred after the alloted 5 years?

I am just wondering if anyone knows whether or not overpayments made by SAAS qualify as being statute barred after 5 years?

At the beginning of this academic year they tried not to give me my bursary as they said they had overpaid £1491 me back in academic year 2004-05.

 

At first I couldn't remember and I challenged the payment.

After thinking about it I realised that that had been the case however, I was under the impression that it had been agreed to add the overpayment onto my total outstanding loan amount.

 

SAAS are now saying to me that they found an email I had sent to them in either 2005 or 2006 saying that the overpayment had been deferred until I graduate or something and therefore, gave me the bursary for this year.

 

They say that I have to start repaying the overpayment when I graduate and that it cannot be added onto the outstanding loan amount as this is different.

 

I then found out that this overpayment may now actually be statute barred.

Can anyone tell me if I have a case here or not?

Hi,

 

I think there's a good chance this overpayment may be statute barred, it's not something I'm sure about, would sending the uni a SAR clarify payments for the year you mention.

Any advice I give is honest and in good faith.:)
