Hi all,

 

Firstly thank you for reading and thank you for any help or assistance you can offer!

 

I've been having a very tough time at work most recently which has lead to depression and me basically wanting to leave...after all my health is more important than my job.

 

its a shame since I've worked for the company for over 3 years...worked my way up from Graduate level to a fairly senior position. Prior to this I loved my job and the company is a well known operates throughtout the UK.

 

Firstly I have had ongoing 'issues' with my boss for some reason he has a dislikely to me...he has only recently started and problems have only occured since his arrival. I have tried to speak with him directly about this but frankly he couldnt care. Since this time he has been almost picking on me and I believe trying to tarnish my personality and character at work.

 

Firstly aquisations were made that meant my suspension from work (this was was dissmissed as there was no evidence backing his claim), 2ndly a written warning against me (as part of initial investigation obnomialies were found) and the management thought it was evidence enough to give me a written warning.

 

Clearly something needs to change and given his seniority above me I believe his word will always be stronger than mine...If I leave would I have a case for compensation against either him or the company??

 

my ace is a recorded conversation which in a nut-shell paints in a terrible light and has him saying some terrible things to me..

 

Does anyone have any thoughts??

Sorry to hear of your troubles; if it's any consolation, I've been in that position and it is not a pleasant place to me.

Constructive dismissal (CD) is notoriously difficult to prove (as I am sure the many employment law specialists on here will tell you) so before you consider that, let's look at some alternatives.

Is your manager like this with anyone else or just you - start keeping a diary of the incidents that occur; what was said, day, date, time, who was present and DON'T leave it in work.

Does the company have an anti bullying policy? If so get a copy and read it.

Wherever possible conduct your business with this manager by e mail so that you have a written record

If you are called into a meeting with him or her make sure you take in a union rep or trusted colleague to take notes for you; it I'd YOUR RIGHT to be accompanied

If you are in the union you could speak to the rep about it.

You could also look at the ACAS website for more information.

I believe it is just me he treats like this, I have made some notes of dates/times when these instances have occured

there is no anti bullying policy in place.

 

what I would say is given his seniority in the company it most certaintly feels like the company are offering him more support than I.

 

many people have said I should take a case like this public given they would most likely compensate me to effectively keep my mouth shut- would this be an option. I have been paid through out my suspension however it has almost come to a case where I feel I can no longer work at the company in the same capacity as before.

 

given the situation I think it only a matter of time before they have 'reasons' to dissmiss me completely then it leaves me without a job and on the back foot of making any claims against the company?

Are you a union member and if so have you spoken to your rep about the situation?

As much as I'm sure you feel like jacking it all in, I would wait until they do dismiss you (if that is where you think it's going) after all why make it easy for them. I'm sure the experts on this forum will be able to give you the chapter and verse on that when and if it happens.

You don't have to tell me the name of the company, but could you let me know the nature of your employment

I am a trade union memeber however I have joined a little late.....almost like trying to get house insurance while your house is on fire! so they cant represent me at all only offer minimal advice

Its within the financial sector...its a very well know company and ironically in the times top 100 companies to work for

Well I suppose it's good you've got arms length support from the union.

I know that the financial sector can be a bit cut throat at times but even so nobody should be bullied in the workplace it is after all the impact of it not the intent of it.

There is sufficient case law which proves the causal link between workplace stress and psychiatric injury. Use your time wisely whilst you are suspended; go to your GP tell him/her about the bullying and how it has affected you... That information will be documented should you need it in the future. Hang on to your recording, that too may prove useful; save it on to your home computer so it doesn't get inadvertently taped over.

Get together all your evidence (e mails, diary entries, letters etc) and put them in a file in chronological order.

This will not only make you feel better in yourself by giving you control over the situation but it will organise all the information for future reference.

In my opinion, this person sounds like a sociopath; they're obviously jealous of your knowledge and the only way they can make themselves feel less insecure is by bullying you.

I am not an employment law specialist but there are lots if people on here who are and can give you information about the legal position.

As I said earlier I have been in the same position as you and although it doesn't feel like it now, things happen for a reason and you're obviously meant for better things.
