      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi all

 

i made the big mistake of getting a payday loan from cfo and due to changes in my employment i contacted them before the loan was due to explain my problem and asked if i could set up a payment plan and after a few days i recived a email back saying:Thank you for your email.

 

We are legally obliged to accept any payment sent to us from you or any third party on your behalf.

However this does not stop us from chasing the balance until it is cleared in full directly with ourselves.

 

Your contractual obligation is to pay the full balance off.

Whilst you are paying them we will call you daily to get the full balance recovered from you.

 

I suggest you contact us either directly by E-mail or call us on 02081661470 to arrange something.

 

Going with a Debt Management company as advised will not stop us calling,

E-mailing or passing your account to, an external door to door Collections Agency to recover the balance.

We will also not freeze contractual fees and charges to the account until this is sorted with us directly.

The very next day i got a text message saying it was from pre removal saying:

I am due to CALL to your address on 16/01/12 between 1pm-9pm to STOP action call 01747593007 to make a token payment. L WRIGHT CASE ID ******

 

So in a panic i went and put my last £20 into my bank to make a token payment

rang them i they say they dont deal with any payments below £50

so again in a panic i borrow £30 off my partner put that into my bank and as i am walking out of my bank

i begin to ring them bank to make a payment

they take my card details off me and to my shock it says it has declined

 

i tell them that, that is impossiable as i put it in my bank in cash 30 seconds ago

i check my balance and the money is there and mt collect say it might just take a little while to clear.

 

i return home to check my bank account online and the money is gone

i contact mt collect again to set up a payment plan and they say they have not had the money and will not set up a plan until they recieve so money from me.

 

so i ask for some time to find out what has happened to the money i put into my account,

 

the next day i get a phone call in work from some guy called micheal (who has a real attitude)

saying they want there money blah blah blah agin

 

i ask for time to find out what happened to the money in my bank.

 

now this morning i check my bank and there it is 2x£25 debit card payments to CFO on the day i put the money in my account

so they have said it declined but they did take the money:mad2:.

 

my question is having read some of the other stories on here from people who have dealt with this company

what is my next step with these and is there a better way of dealing with them.

Yeah deal with them in writing only. Ensure your written communication states formal complaint.Ignore the pre-removal text from MT Collect and report - it has now been proven this is Capital Finance One just under a different name. This is one of the worse s***ks out there - get rid of or learn to put up with their threats which never really amounts to anything. I think a certain director gets his training from a Mr Hart!

Couple of comments on these, they are the lowest of the low, I believe my outstanding amount is now over £1k and have had the usual threats of visits etc. One of the issues I have had is their claim that all emails questioning the validity and enforceability of their contract from me were delivered to their spam folder (I had no response when I asked why they didn't review this, I assume because they are lying), hence their complete lack of replies for months. They stated their spam folder was deleted on a daily basis however they managed to locate my emails when I phoned them which kind of goes against their previous comment about them being deleted anyway. I am now making a point of printing emails I send to them and putting them recorded delivery in the post.

 

I have always said for these to bring me straight to court as I would like to see them justify things like this to a judge but they have gone quiet for now.

mjds and i-hate-cfo - hold on in there your doing the right things x

May be also try trading standards, oft and Consumer Direct - see postings by Silygirl1 for how you go about it

 

I'm sadly actually reluctant to keep quoting the British Cheque & Credit Association (BCCA) - I notice they changed their contact details not so long ago which may or may not be a good thing - I just don't see how it can allow membership when they are must be aware of the games CFO play

 

To complain to the BCCA about CFO - you need to HAVE complained to the company in WRITING and it is best to have a papertrail

but be warned CFO have great experience of trying to backtrack along with their long standing denying of correspondence received and payments made to their advisors 'disappearing' but I remember being advised by the lady at the BCCA that the chief Executive is as real as you and I when I approached them.

 

It really is a sick game they play, but they are harmless in that their threats don't amount to much if you can sit through the nasty calls/text messages

 

I found my nasty call received was towards the end of my bother with them - see it as a signal ? x

thanks for the help after reading so of the other stories on here about them i think this might get ugly but i am going to fight them. if there is anyone else out there with any advice i would be very grateful.

 

I applied for a loan with them and I was declined so thought no more of it until a couple of weeks later my bank account was debited by £400! Ive argued the toss with them, sent my bank statments proving that I never recieved a loan in the first place but nothing! In the end i went to the financial ombudsman who have just ruled in my favour- CFO did'nt even reply to any of their letters! Don't do anything else, refer to ombudsman, they were great x

they have no legal right to threaten you

they ARE NOT bailiffs

 

you MUST phone you r bank NOW

and tell them your card details have been compromised.

 

also tell you bank NOT to honour ANY more requests for payments.

 

pay IN YOUR OWN TIME via internet banking.

 

they are a DCA they have NO LEGAL powers

 

COMPLAIN via the consumer direct website and copy any emails AND texts to them

 

do not answer your phone to them again

 

your under NO LEGAL OBLIGATION

to converse with them at all.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi the company behind this text is Equifinace Ltd.

They are linked with Capital Finance One, Loanote and 247/moneybox. Bunch of scumbags..ignore them..

 

You can call them scumbags if you wish, but even bigger scumbags are the authorities who know exactly what is happening and do nothing whatsoever about it. So many times posts say 'report it here or report it there etc' so a complaint is made but they just file your complaint in the bin. The continued existance of these ****** companies is proof enough of that.

 

There is absolutely no reason at all why they have to receive a thousand complaints from a thousand desperate lied to and cheated people before they even concider looking at it.
