      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello there, I to have had exactly the same text messages. I didnt receive mine until 7.25 pm on Friday night, have been trying to call the number ever since, as I have been very worried. But have not been able to get through. Since reading that there are many others in the same situation I dont feel as bothered as I originally was. I live in Bournemouth/Dorset, and now realise, that no one is gonna turn up, or at least I hope not. I have two young children, and my youngest has been very distressed, as he can see that I have been very upset.

I am more than willing to arrange a payment plan with whoever this is, but I feel that there manor in which they are going about this is very wrong. My new year was ruined last night, I stayed in worrying thinking they were coming today to remove goods from my home....nasty people.

Hello there, I too have received exactly the same text messages. Received at 7.25 pm on Friday night, have tried to ring the number, but no reply. I have spent all weekend worrying that someone was coming to remove goods from my home. Feel much better now realising that many others have receiced exactly the same text.

Stay off the phone unless you can record the call! They want you to phone them so it is playing into their hands. Wait until they write to you properly, if they do at all. I you do feel like phoning them just tell them that you want communication in writing only regarding whatever their business with you is. DO NOT get into discussion or give them any personal details. If anyone turns up on your doorstep hand them the 'Doorstep' letter.

 

I would phone Consumer Direct when they reopen and report this to them as a serious complaint.

I have today telephoned, and told them how it is.

 

I understand they bought the debt for a very cheap price, and are trying to make money.

 

I have said I am willing to pay the monies due, but will only play them by standing order, then I am in control.

The details have been given to me.

I also informed them that this was a scare tacktic, and I am not falling for it, as they can only take goods with a court order which they do not have.

 

I feel happy now I have sorted the situation.

 

If anyone phones them I suggest they do the same by standing order,

then they dont have your card details,

and cannot hammer your account.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

How do you know they are even entitled to any money? I could look at your credit files, get your phone number from the mob directory then txt you with a messge threatening you over anything I find in your cra records. I too would be happy to provide you with a sort code and ac number upon request.

 

Not saying that's what these people have done but anyone with access to your CRA files could do this and you'll find that's an awful lot of people you've never heard of.

 

Now you can see why they break and bend the rules, if you can't everyone else following this recent text campaign can. :|

As of 03/03/12 please do not under any circumstances wait for my further input or guidance on any current thread or defence of a court claim I might have been involved in on or through Cag.

Rachiebabes. Do you know how you actually owe the money for? If that's the case I will send you my bank details, you have an outstanding debt to me and I will be calling at your home between 6th January and 31 dec to make arrangements or seize goods!!!!!!!!!

 

What you really should do all those people that got letters stating a visit on the same day is combine your letters and report to the same person in TS.

 

I smell troll here, yeah great idea everyone just set up a standing order and pay some random debt........as some said you can take a horse to water but can't make it drink

My respect to people who post regularly and help people out on here. Without your help alot of wrongs would have been committed.
