      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had one of these texts today,

I rung them, they were so rude!

 

I told them I am not in a position to pay the debt at the moment and they said that until they get a token payment they have a warrant of execution

and will be coming to my property on saturday unless I pay it by 2pm on Fri.

 

I am panicked I have to admit as I share a house and my housemate has children.

 

I really do not want these people showing up.

 

People on here seem pretty convinced that these guys are hoaxers and scare mongerers but what do I do if they do turn up?

I demanded their postal address off of the agent to make the payment as I refused to give them any card or bank details and have managed to get this.

 

Some advice of what to do would be great!

 

These seem like nasty people!

Even when I said that I was willing to set up a monthly Payment Plan with them!

 

They just said well loads of people want to do that but until you make a payment you can't do it!

Following on from my original comment on another Thread regarding a debt company that is texting people demanding payment or they will send people round to collect goods,

their postal address is MC Collect, Kirkdale House, 7 Kirkdale Road, London, E11 1HP.

 

From what i can work out from reading people's comments, this is their main office.

 

I had to fight to get this address and I intend on sending them the doorstep letter!

 

After reading the comments on here,

I should never have called them but I was petrified!

 

They are rude and nasty people! Any other advice would be helpful!

The debt is for a PDL.

Yes it is my fault that I ran up the debt, but I offered to pay the original company and they never responded even after chasing.

NEVER will i take a PDL out again!

Oh to win the lottery and tell them to get stuffed!

They certainly don't have a warrant of execution - they would only be able to get that IF they took you to court and then IF you did not pay the court order! It's a shame you didn't record them saying they had a warrant - Trading Standards and the OFT would be very interested in that statement!

01704610001 and the PDL is a yr old.

Thing is, they have my old address, they didn't comfirm and personal details with me.

Just the case ID.

 

Still doesn't mean they don't have my new address though as I know what these companies are like! I do however, have a guard dog!

Fist of Vicky, no one will show up, it's all lies and intimidation to get a payment out of you, and even if they do show up at your new address, just tell them to get off of your property or you will call the police, they have no legal powers to turn up and demand money like anyone knocking on your door and asking for money.

 

Do not ring them, if they ring you, just say "in writing only" and hang up.

 

You need to send MC Collect a CCA request, template above in the templates section, enclose a £1 postal order and do not sign the letter, just print your name.

 

When/If MC Collect get back to you, scan and attach in .PDF format and attach to your post, but please remove all personal details, barcodes, reference numbers and any indentity markers.

 

Do not lose any sleep, have a read around the pay day loans forum, you'll soon see that DCA's use threats, lies and intimidation so the phone monkey can get his/her 20% commission.

Just rang them and got some little boy, who only wanted my name to check their system? And claimed that if I didn't give them it then they would continue to ring and leave text messages on my phone? Told him they would do no such thing, and that I didn't owe anyone anything, it went round in circles until he gave up saying, 'right I can't be bothered' and hung up.

 

Bless em, Happy New Year to you too, Mcall? was the name he used, and I will have to replay the call to find out who he said they work for, but it was defo a PDL company, not at all professional....

mainly capital one finance PDL debts

 

am promised a recording of them saying they will be around at 7.30am to take furniture.

 

and that mr marsden has a special warrant of execution from a judge that enables him

to collect on any PDL loan he wishes

he has a lock smiths certificate he can use too.

Either way he is demanding money with menaces, threatening things he cannot do, and as for a locksmith certificate I think that is complete Bull.

 

This man sounds like he really enjoys intimidating people.

 

Carter Legal would be Carter Forbes, a solicitor for rent firm specialising in Payday Loan debt.

Thank u everyone. I am going to send them a letter today advising them I only want communication in writing and that I want to see proof of this ccj that I have not paid for them to have got this warrant of execution. Bastards!

bearing in mind what was the orginal loan figure

and what you have paid to date?

 

forget any charges they have added, they are a penalty & unlawful

The loan was for £200. Has anyone that has had one of these "Preremoval" texts actually had a visit from this company?

 

No one will be visited, all designed to scare and intimidate you.

 

Even if anyone does show up, they have as much right asking for money as anyone who knocks on your door does, if they do, just tell them to leave, if they refuse call the police.

 

You can also film it on your mobile phone, loads of this footage already on youtube.

Can anyone recommend a debt management company that I can get to deal with my debts that aren't going to rip me off? I need to get on top of my debt and stop this kind of thing from happening again.

Thanks Stigman. Your knowledge seems immense regarding this and is appreciated! Am so paranoid am not leaving any windows or doors unlocked!

 

If any collectors to do turn up (rare but have been known), all they are is just self employed on a 20% commission basis, they are not bailiffs, if they ever try to gain access through an unlocked door or window, the law is exactly the same as a burglar (£2 fine and a rehabilitation holiday in the Bahamas).
