Hi folks. My bank have finally cheesed me off too much and I've decided to puruse action aganst them. Over the years they have charged me hundreds at least in those £30 letters and bounced debits for niggling little amounts over the limit. The last straw was when they decided to do away with my overdraft all together and by the time I got the letter I was aleardy in the red...double stng.

 

Basically I'm klooking for adice on making the cirrect start to this provess.I'll read the FAQ before posting anything else as I'm sure many of my questions will be answered there and it can be annoying seeing the same quations over and over.

You are doing fine so far by reading the forums but yes do please read the FAQ's and the step by step and keep doing this for a few days so you understand it all before you start.

 

Also start your own thread in your banks forum for any other questions you may have and everyone will support/help you all the way.

OK...I have now got my bank statements for the last 6 years and, summing the punitive charges (ie overdraft and bounced DD charges other than interest) it comes to around £630. I think that is an amount worth trying to reclaim so I will now move to the next stage.

I promise to contribute £50 to the site on sucessful conclusion of this :-)

Just to let you all know I am now on round 2 with Abbey - refund of charges since the first set aside and removal of adverse info. Here we go again!!

Hi WhizzKid,

 

Having just read this thread from start to finish because I was so hooked I couldn't walk away I would recommend that when Abbey get your second claim they throw in the towel and pay you anything you ask immediately. It will certainly save them a bkoody nose of not worse.

 

Go get 'em sunshine but as I'm just starting my hourney against Abbey, leave some me.

 

Congrats on first win and GOOD LUCK with number two. although you won't need it. They'll probalby see the name and address and start telling the accountants to write your cheque. :grin: :grin:

Consider yourself lucky that you could read it from start to finish. Those of us on the edge of our seats during round 1 kept having to wait to see what happened next, not least WhizzKid.

 

I'm not sure I can go through all that again. I'm almost tempted to wish Abbey luck because if last time is anything to go by they will need it. Almost, but not quite.

I'm with you Caro, I really feel for them, they won't know what hit them, mind you, it serves them right.

 

I'll be with you all the way on this one cos I only started participating a few weeks ago and found this thread by accident today. Once I started reading I was totally hooked and had to see how things went.

Whizzy, good to see you back in action. We have just finished our second claim and they took us to the 11th hour. The ice maiden Inga dealt with it this time rather than DLA Piper but even so the letters were almost the same. We even managed to get a few quid in costs this time.

 

It must be about time for Round 3.

Yep, they don't seem to have learnt much since their humiliating appearance at court last year with their set aside. Early indications are that they are - once again - planning on taking it to the wire but I shall be doing everything possible now to prevent that.

 

They've incurred my wrath today by sending me 28 days notice of intention to default - some of you know what happened when Natwest tried pulling that same stunt (http://www.consumeractiongroup.co.uk/forum/general/61129-natwest-breach-injunction.html) so I may be going down this same route with Abbey soon.

 

Although I only filed my claim yesterday, an early letter has already been drafted to the judge re their previous behaviour and abuse and hopefully they won't be given any opportunity to drag this one out!!

LOL They wouldn't settle any quicker with my second claim whizzy, but I think they might settle quicker with the 3rd claim, although I am not actually sure that they keep tabs on how many claims people are putting in, but I hope you don't have to go through the nail biting that we all had to witness last time - I am not sure that our nerves could cope LOL.

 

So come on James and Inga, have pity on us, pay Whizzy soon :p

I'm prepared, even expecting, them to drag this 2nd claim out - I did remind them in my email though that a refusal to settle at this early stage will be duly noted to the judge. In fact the letter to him has only just been finished and will be delivered to court the moment I get any negative response from them now.

Icy, you need to keep your resolve, stick to your timetables, don't be bullied and remember that you are only excercising your lawful right to recover these penalty charges - you will get them back if you stay focused and determined!

As fully expected, ignorant to the last. No reply to my email asking for settlement negotiation, and yet another 'we are dealing with your complaint' letter received - almost 3 months after my first letter asking for charges to be returned on this second claim!

 

They just won't learn! Letter duly sent to judge Friday, so let's see what happens now......

Rather annoyed to find out this morning that my letter to judge has not yet been referred to him! After expressing my dismay, it will apparently go to him later today.

 

Abbey have now got 2 days to file a defence....
