Hi everyone,

 

I am trying to sort out my finances and defaulted on a loan with Lloyds TSB in 2008.

 

The balance stood at £4000 and although it is showing on my Experian file as a default in August 2008,

I have had very little correspondance from anyone including DCA's regarding payment of this debt.

 

I checked my credit file this morning and in the new alerts section there was a change marked on the Lloyds account

stating the status of the account had changed from defaulted to settled when I haven't actually paid it off!!!????

 

The settled status is not showing on the main Equifax page just as an alert.

Has anyone got any ideas on this one.......Is the account settled?????

Read up on CPUT regs 2008 and protection from harssmanet Act 1997.

 

Get a recording device by your phone ( eg ipod touch or suchlike ) .

 

You are in the fantastic position of being prepared for the run around that is likely to come your way and you have the opportunity now to make some serious money.

Thanks guys......I should add that of the £4000 probably about £1500 is bank charges........Also I've received a letter from Nelson Guest and partners soliciors re: Wescot......re:Littlewoods regarding a debt that isnt on my credit file and is way over 6 years old!!!! Do I send the SB letter to Wescot???

If I was in your shoes, In addition to the obvious goal of getting them out of your life, get yourself very prepared to catch them being naughty, particulalry on the pressing for payment front (after you notifying them it's statute barred) particulalry on nuicanse phone calls ( after you've requested they stop) particularly with lies (when they phone you or you phone them they will say things that are untrue, misleading and unlawful CPUT regs 2008) etc with the aim of sending them a claim for compensation for harassment and distress after you've collected evidence of them doing it. They will do it as long as they think you are a numpty that they can push around.

 

My game plan would be to play the intimidated naive debtor and to entrap them breaking as many regulations and laws as possible. Don't worry about recording phone calls, because they will be recording them too and making reciprocal recordings is absolutely ok.

have you looked into reclaiming charges/PPI?

I havent actually.......If I get in touch with them would start the whole 6 year process again or does that not matter as its already defaulted. My credit file isn't updated with anything different - just the alert that the credit is settled but nothing showing on the actual account when I click on it. Unsure what to do regarding the charges.......would appreciate any advice! I'm a complete novice at this - really want to sort things out so that I'm in a better financial position for mortgages etc.

NO LETTER CAN RESET THE SB CLOCK!

 

nothing to do with the default either the SB clock starts ticking from YOUR last financial transaction.
