I'm not going to argue the legalities of this as I do not have the training nor knowledge. I will leave it for you to take over and do the next few defences and see what happens. I don't have time to spend on this forum counter arguing what has already been discussed time and time again.

 

I'm not here to take over, I'm simply looking to gleen understanding as to what legal principles can be used to overcome PDL claims as a whole. As you know CAG has always taken pride in being an open and free forum integral in helping folks en-masse. It's quite obvious that we are going to have more and more folks with queries of this nature, it's also quite obvious that over time these lenders are going to start bringing more and more solid claims. It's not about any one person in particular writing defences for people - it's about our community coming together to share ideas, and to provide a common platform to assist people to the best of our abilities. I read talk of 'killer defences' yet I don't see a great deal being mooted on the forums. Like our successes with bank charges and the like we are at our best when we all work together and share ideas.

 

All the signs (from CAG and other information too) show that PDL companies are going to get more and more clever, with contractual terms becoming more and more technical and onerous. This is why we all need to work together.

Quick update, MiniCredit are slapping on charges left right and centre, and not answering my emails. How else can I contact them, I'm not ringing an 0870 number. QuickQuid are being a bit funny too, I paid £38.77 and now they say I have to pay the rest of the interest, about £25.00 before I can go on a payment plan, but it has to be today, I emailed back saying it wasn't going to happen.

Hi..I'm in the same boat as you. I contacted Quick Quid on Monday via live chat and explained i was unable to pay. I have set up a Pre-Default Payment Plan but over 4 months starting at the 30/09/11.

glad u got a payment plan but they will record it on ur credit file as when i got my plan last week they emailed me a snotty email saying they will report it on my file ,this is because i told them id reported them for fraud but i couldnt care less what they do as my intention is to be free from them by xmas ,but good luck to u xxxxx:whoo:

QUICK QUIDS NASTY RESPONSE BY EMAIL BECAUSE I REPORTED THEM FOR FRAUD ON MY BANK ACCOUNT
