I need advise what my options are. below is my situation

 

· Took a secured loan of 25k back in 2006

 

· Property worth 400k

 

· Suspended Possession 2009 Aug (didn’t attendcourt hearing. Agreement with solicitor over the phone)

 

· Arrears of 9K

 

· Today offer to pay 3k next pay date and another3 k next pay date they refused. They want me to pay the entire arrears off infull I don’t have those funds

 

Today I receive a letter from GE Money solicitor saying they will apply for an eviction date

 

I am just wondering what my options are. Sorry for being very brief happy to supply more info.

I am pretty confident I can pay off my arrears but need sometime is it to late now?

Hi, what did you agree with the solicitor over the phone?

did they tell you there was no need to attend the hearing?

Have you received the order from the court following the hearing, what did it say about payment of the arrrears?

 

 

You can apply to the court to get a hearing to stop the eviction and allow you to pay the money you have offered. We can help you with that.

That I would pay money towards my arrears (but wasn't able to after couple of months) but that they would still go with the court order but as long as I paid they would not do anything

No they didn't

It only said the order for reposseion was granted

Did you send in a defence to court before the hearing stating how much you would pay?

Did the court order not mention how much you had to pay each month ? It should have said possession was granted but suspended while you pay the mortgage instalment + an amount towards the arrears

Who is the lender?

 

I can help you with the application for a hearing but it will have to be tomorrow as I have to log of in a few minutes. Are you able to get online tomorrow ?

No i didn't send a defence as my Mom was ill during that period and I was more worried about her well being. If you could help me with what application I need to send that would be appreciated then lender is GE Money.

Hi, as you don't have the eviction notice yet, we have plenty of time to get things in order. Can you fill in the affixed budget sheet please (it calculates automatically as you fill it in) as you will need to affix that to the N244. You will need to show how you are going to pay the £3k this month and next and how you are going to clear the rest.

 

Before I can draft a defence statement for the N244 I need to know the following:

 

1. Is the mortgage in joint names?

2. Do you have any children living at home?

3. When you made an agreement with the solicitor before the hearing in Aug 2009 - how much did you agree to pay?

3. What was the reason for not making payments as per the suspended order?
