A family member has today received a letter from the police stating she failed to stop, failed to report an accident and for careless driving.

A couple of weeks ago she was pulling out of a road so was traveling at around 5mph and she hit a cyclist who landed on her bonnet. It was not a major accident, more shock than anything else.

They both spoke to each other and the cyclist said he was fine and went on his way.

She had her grandson, a 15 year old in the car who saw the whole thing and heard the guy say he was fine.

She is now worried about what will happen. Her daughter thinks she is going to jail!

 

Any advice on what might happen next? She has legal cover on her insurance.

some body obviously reported it to the police then!

Is it a notice of inteded prosecution or just that it has been reported?

You need to make a statement to the police, make an appointment and get your side on file. ( obviously did stop anf checked )

The police may then check the facts with the cyclist, if they know who is.

Was there any damage to vehicle or cycle? did you take photos ( phone always a good idea.)

I suppose the cyclist may have thouhgt he was ok. but later felt unwell! or any cctv ay this point

did they exchange details, how did find them, did he make note of reg or a witness note it down.

Defo need to speak to police.

Have you been contacted by any insurance co? maybe an idea to inform yours now in case any claims come up.

By law you have to inform the police within 24hrs of incident involving injury ( or damage if details are not exchanged )

I suspect that the cyclist has now realised that as he was on the major road, then the driver was liable and can get his bike repaired, etc. on the driver's insurance.

 

At this stage, the Police will be seeking to find out the driver's details having been given a VRM. Unless there was injury, they are unlikely to take any further action other than pass on the driver's details to the cyclist to make a claim against the driver. She may a ticking off for not reporting, but if they want to go further, then I suspect that her reasonable defence is that both agreed that nobody was hurt and that was the end of the matter.
